Docket No. 70-7002 Notification that Department of Energy Regulated Activities in the X-705 South Annex are Complete

Dear Dr. Knapp:

The United States Enrichment Corporation (USEC) has completed all Department of Energy (DOE) regulated activities in the X-705 South Annex, which was temporarily converted to DOE regulation to support these activities. USEC has detennined that the X-705 South Annex meets all applicable Nuclear Regulatory Commission (NRC) requirements and Fundamental Nuclear Material Control Plan commitments. Based on the results of a static special inventory of the area, USEC has determined that converting the X-705 South Annex to NRC regulation will not result in USEC possessing (across all leased and NRC-regulated areas) special nuclear material (SNM) of either moderate or high strategic signincance (other than inaccessible residual holdup). Therefore, all applicable requirements contained in the Plan for Achieving Compliance with NRC Regulations at the Portsmouth Plant (Compliance Plan),

Issue A.4, Rev. 7, have been satisSed and the X-705 South Annex is ready to be converted to NRC regulation. A security sweep of the X-705 South Annex was completed for DOE to provide a high degree of assurance that no materials exist in the area that would cause USEC to exceed the Category 111 possession limits (as documented in Safety Analysis Report Table 1-3) across all NRC regulated areas.

l By copy of this letter, USEC requests that DOE notify NRC and USEC of the intent to transfer regulatory l

authority and transmit any open nndings or issues related to the X-705 South Annex, as required by Compliance Plan issue A.4, as soon as possible.

In addition, Reference 1 had requested NRC approval to feed two Sve-inch cylinders owned by DOE as part of the Highly Enriched Uranium (11EU) Refeed project that contained moderately enriched uranium (MEU). USEC is retracting this request since it was not possible to complete all required arrangements with the DOE in time to feed these MEU cylinders under the lieu Refeed project.

GDP 98-0141, Page 2 USEC requests that NRC approve the conversion of the X-705 South Annex to NRC regulation effective as soon as possible after receipt of the DOE notification described above so that other NRC regulated activities that need to be conducted in the X-705 South Annex will not be impacted. While there are no current Planned Expeditious 11andlings (PEHs) scheduled until mid-August 1998, an inability to maintain or establish a fluorinating environment could cause PEli schedules to be revised.
