MILLSTONE NUCLEAR POWER STATION, UNIT NO. 3 - WITHDRAWAL OF AN AMENDMENT REQUEST (TAC NO. M94156)

Dear Mc. Bowling:

By letter dated November 21,1995, Northeast Nuclear Energy Company (NNECO) applied for an amendment to the Millstone Nuclear Power Station, Unit 3, Facility Operating License No.

NPF-49. The proposed change would have modified the facility Technical Specifications (TSs) pertaining to TS Section 1,33 and Bases Sections 3/4.3.3.9,3/4.3.3.10, and 3/4.11.2.1. The change would have clarified the definition cf source check to include a source check from a light emitting diode, as well as from ionizing radiation. Subsequently, NNECO determined that it would not pursue this issue; and, during a meeting on July 7,1998, between members of the Millstone Unit 3 licensing staff and myself, NNECO explained that it planned to withdraw the amendment.

By [[letter::B17355, Informs Staff of Change in End Date for First 10 Year ISI Interval & Change in Starting Date for Second 10 Year ISI Interval.End of First 10 Year ISI Will Be Extended to Oct 1999 & Beginning of Second 10 Year ISI Will Begin Apr 1999|letter dated July 14,1998]], I informed you that the NRC would consider the proposed amendment to be withdrawn unless you notify the NRC by July 29,1998, that the NRC's understanding was incorrect. Since the allotted time has passed and you have not responded, j

we consider the amendment request withdrawn.

The Commission has filed the enclosed Notice of Withdrawal of Application for Amendment to Facility Operating License with the Office of the Federal Register for publication.
