Gentlemen:

This refers to our letter dated November 4, 1987, which forwarded the results

of a special safety inspection conducted to review the circumstances

surrounding a mispositioned flow balancing damper in one train of the Control

Room Emergency Ventilation System (NRC Inspection Report No. 50-483/87033(DRP)).

That letter stated that you would be notified of our decision regarding

enforcement actions.

Our evaluation of the matter is complete, and the NRC staff has determined

that certain of your activities appear to be in violation of NRC requirements,

as described in the enclosed Notice. The inspection identified (1) a failure

to perform an adequate preoperational . test to verify the correct flow through

the damper and (2) a failure to promptly correct a condition adverse to quality

in that the damper position was not promptly corrected.

We discussed this issue at an enforcement conference held in the Region III

office on November 10, 1987, between Mr. G. L. Randolph and members of your

staff and Mr. C. J. Paperiello and members of the Region III and NRR staffs.

Although escalated enforcement had been considered for these violations, we '

have concluded that the appropriate enforcement action for this matter is the

issuance of two Severity Level IV violations. A written response is required.

During the enforcement conference, you stated that measures were being taken

to determine whether other adverse conditions had been overlooked during

preoperational testing. In your response to these violations, please describe

the corrective actions you plan to take or have taken in this regard.

In accordance with 10 CFR 2.790 of the Commission's regulations, a copy of

this letter, the enclosures, and your response to this letter will be placed

in the NRC Public Document Room.
