SUBJECT:

REQUEST FOR INVESTIGATION OF ALLEGATIONS OF INTIMIDATION OF FOLEY AND PLANT THORPE PERSONNEL Region V is in receipt of recent allegations of intimidation involving Ken Dukes, a Bechtel Construction Superintendent against two contractor employees.

By a note dated March 9,1984, to Mr. Canter, the RV Project Manager for Diablo Canyon, from a resident inspector at Diablo Canyon, the region became aware of quality related allegations. The region decided to follow the allegation by monitoring the results of the Quality Hotline calls made to PG&E.

On March 19, 1984, two of the original three allegers contacted the Region V resident at Diablo Canyon stating ".. Ken Dukes, has questioned, intimidated, and threatened several contractor personnel for relaying quality related concerns to the Quality Hotline and the NRC staff."

While my staff has initiated a technical review of the issues described in attachment 1 to allegations RV-84-A-0043, investigation by your office of the intimidation aspects of this allegation is requested. Attachment 2 to the allegation sheet addresses this issue.

If the intimidation issue is founded, there will be a violation of 10CFR50, Appendix B.

There is no additional information in writing available in the Region V office on the intimidation issue, but feel free to contact M. Mendonca or M. Padovan, the resident inspectors at Diablo Canyon, for further help. They can be reached at FTS 961-4123.

l Per Marvin Mendonca of the NRC another individual approached the NRC on the problem related to QCSR-015.

As per the telephone conversation, Mr. Mendonca relayed that the person is j

concerned that permits are backlogging and bypassing quality holdpoints is continuing.

He mentioned he'had called NPO concerning the entry permit problem.

I stated f

that findings to-date illustrate that the construction access permit program by NPO is acceptable and that H. P. Foley has experienced an administrative breakdown between production and quality control.

Investigation thus far has revealed that changes have been made, and that Rick Peters of HPF has stated to our QC representative that the administrative mechanisms are available and that the concern has resolved itself.

I told Mr. Mendonca that in lieu of creating another QCSR, I would incorporate this additional information in QCSR-15.

In conclusion, I also assured Mr.

Mendonca we would continue our investigation and obtain immediate corrective measures if such a course of action was necessary.

On March 22, 1984, concerning alleged threats and intimidation of Quality Co i

Power Plant (DCNPP), San Luis Obispo, CA.

l The inquiry disclosed that the incident was reported co the PG&E hotline The investigation determined that and subsequently investigated by PG8E.

the actions of the Bechtel supervisor were not in accordance with accep able construction practices.

Also, be removed from the job site and the request was honored were resolved.

A review of the actions of PG&E resulted in the determination that no further action concerning the matter by this office was appropriate.
