REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE (FERMI 2)(TAC NO. MA2003)

Dear Mr. Gipson:

l By your application dated June 5,1998 (NRC-98-0067), and General Electric Company's (GE's) affidavit executed by Glen A. Watford dated May 8,1998, you submitted an amendment request to revise the Fermi 2 technical specifications to incorporate cycle-specific safety limit minimum critical power ratios (SLMCPRs) for the core that will be loaded during the upcoming refueling outage and requested that Attachment 1, GE Nuclear Energy (GENE) document entitled " Additional Information Regarding the 1.11 Cycle Specific SLMCPR for Fermi-2 Cycle 7," dated May 8,1998, be withheld from public disclosure pursuant to 10 CFR 2.790.

l Your June 5,1998, letter also submitted a nonproprietary version of this GE document.

GE stated that the submitted information should be considered exempt from mandatory public disclosure for the following reasons:

1.

The information discloses a process, method, or apparatus, including supporting data and analyses, where prevention of its ut, by GE's competitors without license from GE l

constitutes a competitive economic advantage over other companies.

2.

The information, if used by a competitor, would reduce his expenditure of resources or improve his competitive position in the design, manufacture, s'nipment, installation, assurance of quality, or licensing of a similar product.

3.

The information contains detail's of GE's safety limit analysis and the corresponding results which GE has applied to actual core designs with GE's fuel. The development of the methods used in this analysis, along with the testing, development, and approval of the supporting critical power correlation was achieved at a significant cost, on the order of several million dollars, to GE.

We have reviewed your application and the material in accordance with the requirements of f

10 CFR 2.790 end, on the basis of your statements, have determined that the submitted 0

information sought to be withheid contains proprietary commercial information.

l Therefore, the version of the submitted information marked as proprietary (Attachment 1 to your go June 5,1998, application) will be withheld from public disclosure pursuant to 10 CFR N\\

2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.
