By letter dated July 2,1996, Northeast Nuclear Energy Company (NNECO) submitted its Third 10-Year Interval inservice Inspection (ISI) Program Plan, Revision 2, and associated requests for ,

included in the submittal were RR-89-19 and RR-89-20, which are related to the inservice testing (IST) program and have been evaluated independent from the other RRs and pas included in the submittal for the third 10 year interval ISI program. RR-89-19 and RR 89-20 requested relief from the visual examinations and functional testing requirements for snubbers and the requirement to develop a replacement plan when removing pressure relief valves for testing, respectively.

Title 10 of the Code of Federal Regulations (10 CFR), Section 50.55a requires that certain ASME Code Class 1,2, and 3 components shall meet the requirements of Section XI of the ASME Boiler and Pressure Vessel Code (ASME Code) and applicable addenda, except where relief has been requested and granted or proposed attemt.tives have been authorized by the Commission pursuant to 10 CFR 50.55a(f)(6)(i) and (g)(6)(i) when it has been demonstrated that the Code requirements are impractical.

Section 50.55a(a)(3) states that attematives to the requirements of paragraphs (f) and (g) may be used, when authorized by the NRC, if (i) the proposed altematives would provide an acceptable level of quality and safety or (ii) compliance with the specified requirements would result in hardship or unusual difficulty without a compensating increase in the level of quality and safety.

The NRC staff has reviewed the information provided by NNECO in support of RR-89-19 and RR-89-20. Based on its review of the information provided using the preceding criteria as detailed in the staff's Safety Evaluation (SE)(enclosed), the NRC staff has determined that:

(1) The proposed attemative provided in RR-89-19 to use the Millstone, Unit No. 2 TSs in lieu of

the ASME Code,Section XI, Paragrerah IWF-5000 requirements for snubber examination and I

testing provides an acceptable level of quaf:ty and safety and that cornpliant,e with the applicable f por1 ions of the Code requirements will result in a hardship without a compensating increase in the level of quality and safety and is, therefore, authorized pursuant to 10 CFR 50.55a(a)(3)(ii);
