REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE OF WESTINGHOUSE REPORT ON AP600 FUNCTION-BASED TASK ANALYSIS

Dear Mr. McIntyre:

By Westinghouse letter NTD-NRC-94-4042, dated Febr'Jary 8,1994, you submitted WCAP-13957, a report on the "AP600 Reactor Coolant System Mass Inventory: Function-Based Task Analysis." The report provides an example of the Human Factors function-based task analysis scope and process used by Westinghouse for AP600 man-machine interface design.

In your letter, you stated that certain information in WCAP-13957 was considered proprietary and requested that it be withheld from public disclosure pursuant to 10 CFR 2.790. The non-proprietary version of the report (WCAP-13958) was also enclosed with your letter for placement into the Public Document Room. Affidavit AW-94-571 executed you on February 11,1994, claims, in part, that the information is classified as proprietary because "[t]he development of the technology described in part by the information is the result of applying the results of many years j

of experience in an intensive Westinghouse effort and the expenditure of a considerable sum of money." In addition, the affidavit also states that this information should be considered exempt from mandatory public disclosure for the following reasons:

The infomiation reveals the distinguishing aspects of a process (or component, structure.

tool, method, etc.) where prevention of its use by any of Westinghouse's competitors without license from Westinghouse constitutes a competitive economic advantage over other companies, c.

Its use by a competitor would reduce his expenditure of resources or improve his competitive position in the design, manufacture, shipment, installation, assurance of quality, or licensing a similar product.

We have reviewed the WCAP-13957 enclosed with your February 8,1994, letter which provides an example of an AP600 function-based task analysis and concluded that it does not contain any information that the staff customarily accepts as proprietary. As a result, the staff has determined that the submitted information sought to be withheld does not contain trade secrets or proprietary commercial information and does not meet the requirements of 10 CFR 2.790(a)(4).

McIntyre July 17,1998 in accordance with 10 CFR 2.790(c), this letter is being forwarded to you as notice that the enclosure to your February 8,1994 letter (WCAP-13957), which provides an example of an AP600 function-based task analysis, will be placed in the NRC Public Document Room thirty (30) days from the date of this letter. If within thirty (30) days of this letter, you request l

- withdrawal of these documents in accordance with 10 CFR 2.790(c), or provide additional reasons for the withholding of information from the documents enclosed, your request will be considered in light of applicable statutes and regulations and a determination made whether the documents wiil be withheld from public disclosure or returned to you. It should be noted that the information in your submittal was used by the NRC staff in evaluating the acceptability of the AP600 human factors engineering program in its final safety evaluation report and must remain on the AP600 docket.
