Dear Ms. Bauman:

This-is in response to your letter dated June 25, 1987, in which you appealed Mr. Donnie H. Grimsley's form response dated June 12, 1987. Mr. Grimsley's form response denied four documents in their entirety which were subject to your Freedom of Information Act (F0IA) request for docements concerning an inspection on August 25-29, 1986, at Stone and Webster Engineering Corporation (SWEC).

Acting on your apwal, I have carefully reviewed the record in this case and have detennined tiat the previously withheld infonnation will continue to be withheld from public disclosure pursuant to Exemption (4) of the FOIA (5 U.S.C. 552(b)(4)) and 10 CFR 9.5(a)(4) of the Commission's regulations.

Your appeal is, therefore, denied..

The three Engineering Assurance Procedures listed on the enclosed apperidix describe the methods and systems by which SWEC accomplishes its engineering work. SWEC provided these procedures to the NRC in confidence for our use in. overseeing SWEC's engineering activities and to enhance the effectiveness of the NRC inspection program of the Comanche Peak project. The Project Procedure listed on the enclosed appendix provides personnel information about many members of SWEC's staff. This information would enable a competitor to identify employees, detennine whether the employees had desirable skills, and potentially allow competitors to hire employees away from SWEC. This information would also reveal the type and mix of employees utilized' by SWEC on the Comanche Peak project, which would assist competitors by showing those disciplines on which SWEC placed emphasis in bidding and being awarded the work.

This is a final agency action. As set forth in the FOIA (5 U.S.C. 552(a)(4)(B)),

judicial review of this decisica is available in a district court of the United States in the district in which you reside or have your principal place of business or in the District of Columbia.

Through public outreach, the Project promotes whistleblowers as agents lL of government accountability. Through it Environmental Whistleblower Clinic, GAP offers assistance to local public interest and citizens l

groups and interveners in the concern for safety at nuclear power plants.

We are requesting this information as part of an ongoing monitoring project of the NRC's' ef forts to protect public health and safety at and near nuclear processing plants and radioactive waste; facilities.
