Dear Senator Specter:

I am responding to your letter dated July 7,1987 regarding concerns of one of l

your constituents, Mr. Robert Wells, relative to the shutdown of the Peach l

Bottom plants.

The order to shut down the Peach Bottom plants was issued when the NRC 1

determined that continued operation of the facility was an inrnediate threat to l

the public health and safety. This decision was made after the initial report of operators sleeping on duty was independently confirmed by the NRC Office of Investigations.

The operating record of the Peach Bottom facility has not been good.

Since March of 1983 eight escalated enforcement actions have been taken by the NRC l

including civil penalties totaling $485,000. This poor performance has also l

been addressed in the annual Systematic Assessment of Licensee Performance Reports.

Based on the licensee's past performance and the seriousness of the longstanding l

pervasive operator inattentiveness while on duty, the shutdown order was necessary and was not an indiscriminate or unfair penalty.

I am confident this information will address the concerns of Mr. Wells.
