NOTICE OF VIOLATION AND NRC OFFICE.0F INVESTIGATIONS REPORT

2-97-024 (SYNOPSIS)
Dear Mr. Keenan:
On June 6. 1998. the NRC completed an' ins)ection at your Brunswick reactor
facility. The enclosed report presents t1e results of that inspection.
During the six weeks covered by this inspection period, our ins)ectors found
that your staff generally took a safety-conscious approach to t1e activities
conducted ~at the Brunswick plant.
However, five violations of NRC
requirements were identified.
These violations are cited in the enclosed Notice of Violation and the
circumstances surrounding the violations are described in detail in the
enclosed report. 'Please note that you are required to respond to.this letter
and should follow the instructions specified in the enclosed Notice when
preparing your response.
The NRC'will use.your response, in part, to
determine whether further enforcement action:is necessary to ensure compliance
with regulatory requirements.-
This inspection re ort a[so includes the findings and conclusions from an
investigation cond cted by the NRC Office of Investigations -(01) and completed
on April 30. 1998.
A copy of.the OI report synopsis.is included as Enclosure-
2.
01 initiated the investigation-to determine whether an employee
deliberately violated NRC requirements while conducting auxiliary operator
. duties. As. indicated in the synopsis. 01 concluded that the employee
deliberately failed to perform an inspection of the diesel generator building
I
as required by procedures and deliberately falsified procedural documentation.

~ Based on the results of the OI. investigation, a violation of NRC requirements
occurred. .The violation involved the saxiliary operator's failure to inspect

the diesel generator building and his subsequent falsification of the

inspection record.
As indicated in the enclosed report, we have determined
that you identified this violation and implemented appropriate corrective

action.
Therefore, a non-cited violation (NCV) is documented in the enclosed
report.

In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice." a copy of
this letter and its enclosures will be placed in the NRC Public Document Room
(PDR).
