NOTICE OF VIOLATION (PERRY INSPECTION REPORT 50-440/97021(DRP))

. Dear Mr. Myers:

This will acknowledge receipt of your letter dated March 23,1998, in response to our letter

dated February 20,1998, transmitting a Notice of Violation associated with inspection

Report 50-440/97021(DRP) for the Perry Station. In your letter, you provided acceptable

l

corrective actions to Violations 1 and 3. However, you stated that you do not agree with

j

Violation 2 (50-440/97021-05(DRP)). Your position was that the material found in the areas of

the emergency service water (ESW) pump house was transient combustible material rather than

intervening combustible material and that transient materials are not considered to be intervening

combustible materials. Therefore, you stated that 10 CFR Part 50, Appendix R, Section Ill.G.2.b

requirements for ensuring separation of cables and equipment from intervening combustibles

. and fire hazards were not violated.

In your response, you also stated that control of transient combustibles was accomplished per

Administrative Procedure PAP-1913, " Control of Transient Combustibles." In your discussion,

you identified to us that the condition of transient materials found in the ESW pump house

combustible free zones was not in accordance with the requirements of PAP-1913, which require

a transient combustible permit for any materials staged in areas which separate trains of safe

shuidown equipment and circuits.

On April 9,1998, we conducted a re-inspection of the circumstances relating to combustible

materials in the areas of the ESW pump house. After careful review of your response and

re-inspection of the circumstances, we have concluded that the material was not intervening

combustible material and agree with your conclusion that the material found was transient

combustible material that was not appropriately marked with a transient combustible material

permit. We determined that this condition was not in accordance with your Administrative

Procedure PAP-1913. Therefore, we are retracting Violation 2 (50-440/97021-05(DRP)) as

issued in the Notice of Violation dated February 20,1998. In its stead, we have enclosed a

violation (50-440/97021-06(DRP)) for failure to authorize, track, and document the use of

transient combustible materialin the areas of the ESW pump house as required by Technical

Specification 5.4.1, which endorsed Regulatory Guide 1.33, Appendix A.

As mentioned above, we have reviewed your corrective actions and found them to be

appropriate for Violations 1 and 3. Your response to Violation 2 is also acceptable for the

attached violation. As such, additional response is not required and we have no further

i questions at this time. These corrective actions will be examined during future inspections.
