As I have indicated in my previous correspondence concerning your request for assistance with proposed studies at the Maxey Flats radioactive waste burial site, several Federal agencies have a possible role. To be sure we all understood the extent of those.
possible roles, I hosted a meeting on September 4,1975, with repre-sentatives of HRC, ERDA, and the U$GS.
It was felt by all in attendance that a clear understanding of.the respective Agency authorities, responsibilities, and availability of resources was appropriate at this time, and would serve to.make future discussions with representatives of Kentucky more productive.
Briefly, the positions taken by NRC, ERDA, and the USGS in their responses to your letter of May 13, 1975, continue to reflect their most current position on the subject. As indicated by Dr. Liverman in his letter of June 26, 1975, ERDA will continue to provide technical assistance in areas of mutual interest, but still cannot offer finan.cial assistance. As they have in the past, ERDA will continue to make available to Kentucky relevant data from operations at the ERDA land burial sites and results of R&D studies addressing burial site operation..The USGS position contained in Mr. Radlinski's reply to you, dated June 11, 1975, likewise continues tc represent their views. They still plan to expend two man-years of effort and $100,000 in both FY '76 and FY '77 in their investiga-tions at Maxey Flats.
In conducting these studies, they will be pleased to technically consult with you and coordinate with any other 7 concurrent studies conducted by your department. As Mr. Chapman stated in his letter dated July 14, 1975, while NRC is not able to provide financial assistance, they will continue to provide technical assistance to Kentucky.
EPA also reviewed your specific study requests, the ongoing EPA-funded effort at Maxey Flats, the recent NRC review group report (dated July 7,1975), and its own current budgetary situation.
In a manner similar to the other agencies, we also reviewed the authorities under which we could possibly act in this case.

2 Our past support of related studies in Kentucky and elsewhere has been undertaken for one or both of the following. reasons:
(a) i to determine the characteristics of the environmental impact of current or projected land burial activities in order to determine whether an EPA-promulgated generally applicable environmental standard should be developed; or (b) to provide direct technical assistance in response to a specific request from a State in an area in which we possess the technical competence.
I do not feel that this office can, at this time, responsibly commit itself to support additional studies related to our standards-setting responsibilities until we:
(1) complete our analysis of the recent NRC report on Maxey Flats; (2) complete our current study at the site; (3) closely review the proposed USGS effort; and (4) determine the information needs that remain. As a result of these efforts, there may be additional studies which ~are appropriate for EPA support in line with our responsibilities in (a) and (b) above, resources permitting. At the present time, however, we do not have any fiscal year 1976 resources available to support such efforts.
I later in this fiscal year, if additional funds become available, our ability to respond will, of course, be reevaluated.

As a specific illustration of such overlap, we find that the proviaions of the regulations promulgated by the Bureau of Environmental Quality, Division of Solid Waste, regarding operations of a " sanitary landfill" are directly in conflict wi'th the provisions of our license issued by your Department.
In particular, I would call your astention to Section 14 (4) (i) of the BEQ's regulations which require that waste be spread and compacted in shallow layers of approximately two or three feet in compacted depth and receive a daily cover of six inches of dirt.
Such a requirement would not only be hacardous to our personnel, but to the environment as well.
s I As a further example, the BEQ's regulations require a bond -
ing arrangement which is necessarily redundant in the light of our present perpetual care and maintenance fund and bonding arrangements.
Also, in recent months we have had contact with

the Division of Air Pollution and the Division of Water Pollution with regard to their jurisdiction over the Morehead site.
As you know, Section 274 of the Atomic Energy Act of 1954, as amended, is a very unique piece of legislation.
It provides l
that before the Atomic Energy Commission, now the U.S. Nuclear l
Regulnyory Commission, can enter iq.to an agreement with any State for the transfer of certain of its regulatory authority over by-j product, source and special nuclear materials, it must find that

Such a finding was made by the Commission when it approved the program submitted by the Governor in accordance with the provisions of KRS 152, covering its proposed regulations, personnel, equipment, budget, etc.
A paramount requisite of the Commission in accommodating the transfer was that the Kentucky Department of, Health (Department for Human Resources) would'be the agency responsible for carrying out the regulatory authority transferred to the State.
This concept is further emphasized in the mandate to the Commission by the Congress that State programs approved by the Commission must be coordinated and continue to be compatible with those of the Commission.
One of the tests applied by the Commission in making its initial determin-ation of the adequacy and compatibility of the Kentucky program, was to subject f.
to public comment as required by law.
To the best of my recollection there was no indication at that :ime that agencies other than the Department of Health would be ragalating those activities subject to the transfer, nor am I aware that the reg-ulations emanating from the Department of Natural Resources and Environmental Protection which affect the terms and conditions of our license have been brought to the attention of 'he NRC.
All of the above leads me to the conclusion that the regulations of the Department cf Natural Resources and Environmental Protection were never really intended to apply to the Morchead site, but this should be made clear to avoid the confusion that now exists.
Accordingly, it is our recommendation that agreement be reached with the Secretary of the Department cf Natural Resources and Environmental Protection to make clear that your office is the controlling authority over our Radioactive Material License 16-NSF-1.
As we face a December 11, 1975, deadline with the Division of Solid Fastes for the posting of a bond or other security as part of their regulatory requirements, we would appreciate your thoughts on this matter as soon as possible.
