PROVISIONAL OPERATING LICENSE NO. DPR-45 -

ANNUAL FEE FOR POWER REACTOR OPERATING LICENSES This is to confirm that Dairyland Power Cooperative.wlll not be required- ,

to (a) pay the annual. fee imposed under 10 CFR Part 171 on " persons licensed'to '

operate a power reactor" during Federal-Fiscal Year 1988 (October.1, 1987 to

, September 30, 1988) or (b) seek renewal'of the exempti~on reducing the. amount I

of such fee which was granted to Dairyland by the Commission during Federal Fiscal Year 1987.

Under 10 CFR Section 171.3, this annual fee requirement only applies to persons holding an " operating license" for a. power reactor as that term is  !

defined in 10 CFR Section 171.5. The definition of " operating license" specifically states that:

It does not include licenses that only authorize possession of' I special nuclear material after the Commission has received a request from the licensee to amend.its 11censetto, permanently R withdraw its authority.to operate or the Commission has permanently revoked such authority.

In this regard, on May 22, 1987 Dairyland requested.that the Commission-l- amend Ats Provisional Operating License No. DPR-45 for the La Crosse Boiling- _

Water Reactor (LACBWR) to permanently withdraw its authority to operate LACEWR. On August 4, 1987 the Commission granted this request:and issued; i Amendment No.-56 to License No. DPR-45 which modified this-'licensa to .

authorize Dairyland to " possess-but-not-operate"_LACBWR, thereby. permanently. :I revoking Dairyland's authority to operate LACBWR.
