l B. Notwithstanding Paragraph A of this Condition, sealed sources designed to emit alpha particles shall be tested for leakage and/or contamination at intervals not to exceed 3 months.

C. In the absence of a certificate from a transferor indicating that a loak test has been made within 6 months prior to the transfer, a sealed source or detector cell received from another person shall not be put into use until tested.

14. Except for plutonium contained in a medical device designed for individual human application, no plutonium, regardless of form, shall be delivered to a carrier for shipment by air transport or transported in en aircraft by the licensee except in packages the design of which the NRC has specifically approved for transported of plutonium by air.
15. Radiation survey instruments shall be calibrated by persons specifically authorized by the Commission or en Agreement State to perform such services.
16. The licensee may transport licensed material in accordance with the provisions of 10 CFR Part 71,

" Packaging and Transportation of Radioactive Material."

Amendment to Radioactive Materials Licenses As result of a review of our operation with respect to NRC Information Notice 97-89: Distribution of Sources and Desices without Authorization, we request that the following changes be made to our SNM License:

During our review it was discovered the RS-P6 Detectors were being distributed with U 234 used as an internal check source vice U-235 as specified by Condition 10.A of NRC License SNM 1826. An LIV has been written detailing the violation and corrective actions to be performed to preclude reoccurrence. As a result, all pending shipments have been halted. Prompt action on this request would aid greatly in meeting shipping schedules for customers of this product due the week of March 23,1998.

Licensee Identified Violation (LIV) - Failure to comply with Materials License SNM-1826.

re: U-234 source in a Counter NRC License SNM-1826, Amendment No.10, Condition 10.A provides for Desice Model No. RS-P6 Series Proportional Counters to contain U-235, counters were distributed using U-234 as an internal check source.

Background

The detector in question had been discontinued in favor of a later model using thorium foil as the internal check source. A request from a customer to purchase the old style detector initiated a routine internal review consistent with NRC Information Notice 97-89: Distribution of Sources and Desices Without Authorization. Tis review determined that U-234 was used as the check source versus U-235 which is listed on the license. Further, it was identified that U-235 had never been used as a check source for the RS-P6 series detectors. It was determined that distribution of the RS-P6 detector with U-234 instead of U-235 violated the condition of the license. The amount of U-234 contained in each detector was 1.5 nanocuries.

In accordance with NRC General Statement and Policy and Procedures for NRC Enforcement Actions (NUREG-1600, July 1995), the following is provided in accordance with the Mitigation of Enforcement Sanctions (VII B):

(a) It s as identified by the licensee.

(b) It was not a violation that could be reasonably be expected to have been prevented by the ,

licensee's corrective action for a previous violation or a presious licensee finding that occurred I within the past 2 years of the inspection at issue, or the period within the last two inspections, whichever is longer; (c) It was or will be corrected within a reasonable time, by specific corrective action committed to by the licensee by the end of the inspection, including immediate corrective action and comprehensive corrective action to prevent recurrence; Immediate Corrective Action:

- The shipment of any RS-P6 detectors containing U-234 will be suspended pending an amendment to license SNM-1826 to include U-234 in the isotopic listing for that detector.

- An amendment to the license will be submitted by GE and approved by the NRC prior to j shipment of this type detector. In addition, in order to prevent recurrence of this type of situation, Quality Assurance procedures have been resised to seguire RSO signature on all design changes invohing the use of NRC licensed matdl.

Please be advised that your license expires at the end of the day, in the month, and year stated L_ in the license. Unless your license has been terminated, you must conduct your program involving byproduct materials in accordance with the conditions of your NRC license, representations made in your license application, and NRC regulabons. In particular, note that you must:

b. When the mailing address listed on the license changes. (No fee is required if the

, location of byproduct material remains the same.)

3. In accordance with 10 CFR 30.36(b) and/or license condition, notify NRC, promptly, in writing, and request termination of the license when a decision is made to terminate all activities involving materials authorized under the license.

! your license expires is a violation of NRC regulations. A license will not normally be i renewed except on a case-by-case basis, in instances where licensed material has never i been possessed or used.

~ In addition, please note that NRC Form 313 requires the applicant, by his/her signature, to verify l

that the applicant understands that all state.monts contained in the application are true and correct to the best of the applicant's knowledge. The signatory for the application should be the licensee or certifying official rather than a consultant.

You will be periodically inspected by NRC. Failure to conduct your program in accordance with l NRC regulations, license conditions, and representations made in your license application and l-supplemental correspondence with NRC will result in enforcement action against you. . This could include issuance of a notice of violation, or imposition of a civil penalty, or an order suspending, modifying or revoking your license as speedied in the General Statement of Policy and Procedure for NRC Enforcement Actions. Since serious consequences to employees and the public can

! result from failure to comply with NRC requirements, prompt and vigorous enforcement action will l be taken when dealing with licensees who do not achieve the necessary meticulous attention to detail and the high standard of compliance which NRC expects of its licensees.
