COMMISSIONER DIAZ' COMMENTS ON SECY-98-058 In my votes for SECY-96-267 and SECY-97-127, I have expressed my view that we need to bring closure to nuclear power plant fire protection. I stated in 1996 that the staff needed to expeditiously bring to the Commission their recommendations and suggested a five-year time i

span for closure. Therefore, I approve the staff recommendation of Option 2 in SECY-98-058.

l The stafT should defer rulemaking and work with NFPA and the industry to develop a risk-l

. informed, and ultimately performance-based fire protection standard on an expedited schedule (I l'

understand that the NFPA schedule calls for completion of the standard in 2000 and staff approval in 2001). At the same time, the staff should consolidate and revise the existing regulatory guides, as appropriate, to generate a comprehensive regulatory guide that allows for risk-informed, and ultimately performance-based methods to be used in meeting the fire i

l protection standard.

The stafTneeds to provide to the Commission a list of the fire protection issues to date and their

proposed resolution. In addition, the staff should ensure that the proposed resolution ofissues can be accomplished through implementation of Option 2.

RES should summarize the " State-of-the-Art" from the completed NRC fire protection studies in a report to the Commission and seek Commission approval before initiating any further r arch.
