APPLICANTS' RESPONSE TO APPEAL BOARD ORDER OF OCTOBER 13, 1987:

SUPPLEMENTAL MEMORANDUM By an order served October 14, 1987, the Appeal Board I

directed the Applicants to file a supplemental memorandum j

concerning the "Merrimac Sirens."

The Appeal Board granted Applicants' Motion to extend the time for filing until October 30, 1987.

By way of response, Applicants rely upon i

In addition, the Appeal Board has made two further i

inquiries.

The Board asked about the current status of the i

appeal to the Supreme Court of the State of New Hampshire 1

the siren pole matter.

Applicants report that, by inquiry made this week, the above-referenced matter has been briefed and was argued on October 7, 1987 before the New Hampshire Supreme Court.

A decision is pending.

The Appeal Board asked further for an estimate of when this appeal might be decided.

A decision may be anticipated within two to three months, although such matters are entirely within the control of the Supreme Court of New Hampshire.
