This is in response to your letter dated July 30, 1987 (reference #696-1097),
j in which you requested a time extension for submitting a Fundamental Nuclear Material Control Plan (FNMCP) in accordance with the new regulatory requirement of 10 CFR 74.51(c)(1).
We have determined that you need not submit a 74.51 FNMCP provided your existing shutdown mode for high enriched uranium operations remains in effect, and you have no definite plans to resume HTGR fuel fabrication or initiate new operations involving five or more formula kilograms of stratetic special nuclear material. We have also determined that the granting of your request will not adversely affect the common defense and security nor the public health and safety, and is otherwise in the public interest. Accordingly, we are issuing new License Condition 2.5 to Amendment SG-1 of your License No.
SNM-696 effective immediately, to read as follows:
2.5 Notwithstanding the September 25, 1987 deadline specified in 10 CFR 74.51(c)(1), the licensee shall submit the called for Fundamental Nuclear Material Control Plan (FNMCP) within 180 days after and if (1) a commitment is received from Public Service Company of Colorado to order additional high enriched uranium fuel, or (2) a decision is made t,y the licensee to initiate other processing activities involving five or more formula kilograms of strategic special nuclear material.
In no event shall processing activities associated with either item (1) or (2), above, be initiated prior to the submittal of the specified FNMCP.
If submitted, the FHMCP shall be implemented within 90 days following its approval by the NRC.

We have determined that your 696-1097 letter, dated July 30, 1987, contains information of the type specified in 10 CFR 2.790(d). Accordingly, pursuant to Section 2.790(d)(1), such information is deemed to be commercial or financial within the meaning of 10 CFR 9.5(a)(4) and shall be withheld from public disclosure unless subject to the provisions of 10 CFR 9.12.
