SUBJECT: NRC INSPECTION REPORT 50-445/98-03,50-446/98-03 AND NOTICE OF

VIOLATION

Dear Mr. Terry:

From March 29 through May 9,1998, an inspection was conducted at your Comanche' Peak

Steam Electric Station, Units 1 and 2 reactor facilities. The enclosed report presents the scope

and results of that inspection.

During the 6-week period covered by this inspection period, activities at the Comarche Peak

facility were generally characterized by safety-conscious operations. However, five violations

are documented in the enclosed inspection report. The first violation is related to design control

. problems associated with the emergency core cooling system transfer to cold leg recirculation.

The problems are related to inconsistencies between the plant licensing bases, the design

bases, and the emergency operating procedure. The second violation represents a failure of

your 10 CFR 59.59 Safety Evaluation process to identify unreviewed safety questions

associated with changes to the emergen::y operating procedure for transfer to cold leg

recirculation. The third and fourth violations relate to problems experienced during reduced

inventory operations. The fifth violation involved a failure to take adequate corrective actions to

address tomado venting by the fire doors for the uninterruptible power supply rooms.

These violations are cited in the enclosed Notice of Violation (Notice) and the circumstances

surrounding the violations are described, in detail, in the enclosed report. Please note that you

are required to respond to this letter and should follow the instructions specified in the enclosed

Notice when preparing your response. The NRC will use your response, in part, to determine

- whether further enforcement action is necessary to ensure compliance with regulatory

requirements. During the exit meeting on May 14, your regulatory affairs manager indicated that

he believed that the potential violations conceming the midloop level indicators met the criteria

for enforcement discretion, and that he did not believe that you had violated 10 CFR 50.59 USQ

criteria. We considered his comments during our review of these issues.

A partial loss of reactor coolant system level indication during midloop operations occurred

during this inspection period. This resulted from the installation and use of temporary pressure

gauges for troubleshooting reactor vessel level indication problems and because of limited

engineering involvement. Since reduced inventory operations require special attention and a

higher level of awareness, the NRC is particularly concemed with the circumstances

surrounding this event. As a result, we have scheduled a management meeting with you to be

conducted at your facility July 20,1998. Please be prepared to discuss your findings and

proposed corrective actions during this meeting.

In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," a copy of this letter, its

enclosure (s), and your response will be placed in the NRC Public Document Room (PDR).
