'j WEEK ENDING OCTOBER 23, 1987 Seabrook-On October 13,'1987,- Directors of Public Service Co. of New-Hampshire i

(PSNH) voted to default (suspend scheduled interest payments on various bonds) a $37 million debt payment due Thursday, October 15, 1987. On October.16, 1987, T. Feigenbaum, Vice President of Engineering &_ Quality a

programs, New Hampshire Yankee Division (NHY) of PSNH informed me that 1

PSNH did default on their $37 million debt payment in order to conserve cash during the time debt restructuring-is taking place.

PSNH is still hoping that a restructuring plan they. have will_.get them out'of having.

to file for reorganization under the federal bankruptcy code.

l PSNH, in response to questions formally raised on August 17,.1987 by the L

NRC, stated that the initiation of bankruptcy proceedings for~PSNH would not of itself affect the contractual obligations of PSNH under the Joint.

Ownership-Agreement with the joint owners to pay currently its share.of-the Seabrook cost to-maintain a license. to operate. PSNH notedtthat, in j

i the event of. bankruptcy, as' debtor in possession, Lit will have access to a cash flow from its continuing utility operations and external borrowings to more than sufficiently meet PSNH's share of the Seabrook Station operating costs.

Illinois to Seek Amendment to Sec. 274b Agreement Terry Lash, Director, Illinois Department of Nuclear Safety, has informed:

l SLITP that the State intends to seek an amendment to the Section 274b-AgreementtoaddSec.11e.(2)byproductmaterial.

If approved, this would give the State regulatory authority over radioactive materials at the,

Kerr-McGee site at West Chicago categorized as tailings and wastes produced by the extraction or concentration of uranium or thorium from ore processed primarily for its source material content. This. category was not included in J

Illinois request for the present Agreement which became effective June-1, 1987. A draft application for this amendment will be submitted to NRC for review and connent.

Differing Professional Opinions Special Review Panel a

The three Subpanels completed activities, including their oral and written-reports which were given to the Panel'on October 19.. Consultants-gave their-reports to the Panel on October 22.

The Panel is developing. findings, conclusions and reconnendations based on all-information provided. ' The next Panel meeting'is scheduled for November 2.-

The site visit was-conducted as part.of' the SC license renewal and.as a routine. inspection. 4 ITEMS OF. INTEREST OFFICE OF ENFORCEMENT Week Ending October 23, 1987 The following Significant Enforcement Action was taken the week of October 19, 1987. 1. AnOrder(EffectiveImmediately)anda.NoticeofViolationandProposed Imposition of _ Civil Penalty in the amount of $225,000 was issued to-Florida Power and Light-Company (Turkey Point, Units 3 and 4) on October 19, 1987. The order confirms-the licensee's plan to have an independent third party review activities at Turkey Point and the company's corporate offices to detemine the root causes of the facility's poor past performance. The Notice of Violation is based on three violations including (1) loss of emergency boration flow paths for both units, (2) isolation of the backup nitrogen system for the Unit 4 Auxiliary Feedwater System flow control valves for approximately 20 hours, and (3) operation of the Unit 3 Intake Cooling Water System outside the plant design basis. (EN87-86) 2. An Order Imposing Civil Penalties in the amount of $3,250 was issued October 20, 1987 to Eastern Testing and Inspection, Inc., Pennsauken, New Jersey. The action was based on several violations involving (1) failure-to maintain an audible warning signal to a permanent radiography cell in-an operable status, (2) failure by radiographic personnel to prop.erly use their dosimeters, (3) failure by management to audit' activities of_certain-radiographic personnel at the required frequency, and (4) transportation of a radiography source to a field site without the source being accompanied ~ by the required shipping papers. _The penalties were mitigated by 50% because of the licensee's ability to pay. (EN87-58A) 3. A Notice of Violation and Proposed Imposition of. Civil Penalties in the amount of $2,000 was issued on October 22, 1987 to BP Oil, Inc, Marcus Hook, Pennsylvania. The action was based on violation including (1) excessive radiation levels inside an acid storage tank, an unrestricted area; (2) performance of maintenance by approximately 27 individuals inside or near the tank without the sources being in the locked or shielded position and without a radiation survey being performed prior'to the work; (3) removal of the nuclear gauges from the tank by unauthorized individuals while the gauges were in the unshielded position; and (4) failure to place the gauges in a shielded storage container. (EN 87-87) 4. A Notice of Violation and Proposed Imposition of Civil Penalty in the a amount of $12,500 was issued on October 22, 1987 to Babcock and Wilcox Company, Lynchburg, Virginia. The action was based on numerous violations-of radiation safety requirements including failures to do adequate bioassay evaluations, wear appropriate protective clothing, and do l adequate surveys.
