Subject:

PROPOSED IMPOSITION OF CIVIL PENALTY - $25,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of Twenty-Five Thousand Dollars ($25,000) will be issued on or about July 17, 1987 to Duke Power Company for its 0conee Unit 3 facility. This action is based on the failures to properly implement a start-up procedure which resulted in two High Pressure Injection (HPI)- trains and all three Reactor Building Cooling (RBC) units being inoperable. The HPI trains were made inoperable when the suction valves to the Borated Water Storage Tank were closed and de-energized for 21 hours2.430556e-4 days <br />0.00583 hours <br />3.472222e-5 weeks <br />7.9905e-6 months <br /> during a reactor start-up. The RBC units were made inoperable when the cooling water was isolated to the RBC units for 21/2 hours during the same reactor start-up. The civil penalty was mitigated based on the lice::see's prior good performance in the general area of concern and prompt and extensive cor-rective actions. However, full mitigation was not considered appropriate because of the duration of one of the violations including several opportunities for control room personnel to identify and correct the situation and the multiple violations.

It should be noted that the licensee has not been specifically informed of the enforce-ment action. The Regional Administrator has been authorized by the Deputy Executive Director for Regional Operations to sign this action. The schedule of issuance and notification is:

The licensee has thirty days from the date of the Notice in which to respond.

Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
