The NRC Staff intends to call four witnesses:

Fisher Michael LaMastra Edwin Flack Dr. Spitzberg will give testimony concerning the circumstances leading up to the revocation order; Dr. Fisher will give testimony concerning the toxicological hazards of depleted uranium, suitable controls for processing depleted uranium, the use of Reg. Guide 8.22 for this type of application and the meaning of the bioassay samples.

Edwin Flack will address the enforcement decis'.is made in this proceeding as they relate to enforcement policy. Michael LaMastra will testify to his telephone conversations with Mr. Larsen regarding general licenses under 10 CFR $ 40.27 l

As the senior member of the materials inspection staf f, Dr. Spitzberg has been frequently assigned to the more cceplex cases and tecinical issues related to health sh> sics, radiological assessment, and indsstrial hygiene. In 1984-1905 he was assigned major responsibilities in the NRC's response to the contaminated Me>ican steel incident. His efforts included the planning, equ'pping, and ; raining of operators for a U.S. - Mexican border survey and men'toring network to detect radioactive materials coming across the border. In 1987, ne was assigned as the Regional

. Project Manager for the Sequoyah fuels Uranium Hexafluorice Conversion Facility to oversee the recovery, plant modifications, and restart of the f acility following the 1986 accident involving a major release of UF6 ' I" 190b' h' #85 assigred as the Project Manager fcr the NRC's first multi-site broadscope master materials license issued to the U.S. Air Force. Dr. Spitzberg has, un several occasions, been dispatched at the initial agency responder to accidents, incidents, and suspected m erexposures.

Prior to becoming a Senior Radiation Specialist, Dr. Spitzberg performed safety inspections at operational and near operational pcwer reactor facilities.

Inspections were conducted in all phases cf plant operations involving i radiation safety including facility raciation protection, radioactive waste I

systems, solid radioactive waste packaging, classification, and shipping, ALARA programs, environmental monitoring, p ergency preparedness, and outage activities.

Dr. Spitzberg's graduate research suc'es have been in the area of low level environmental raciation measurement techniques, fccusing on tritium; the ,

l modeling of environmental and hurtan prysiclogical transport kinetics for tri .ium; and more recently, the interpretation of uraniur bioassay sample  ;

series, and modeling of human excreticn patterns following intakes of the hydrolysis products of uranium hexaflucrice.

Professional Experience Dr. Fisher is a health physicist specializing in the dosimetry and health effects of internally deposited radioactive materials. His primary research interest is in development of improved methods for calculating radiation doses from internally deposited radionuclides, and the application of microdosimetry to practical problems in radiobiology and radiation protection. This work i involves the correlation of radiation dose at the organ, multicellular and cellular level with observable short and long-term effects such as cancer ,

induction, mutation, cell killing, and chromosome damage.

l Dr. Fisher is manager of the multilaboratory Internal Dosimetry and ,

Measurement Upgrade research program for the U.S. Department of Energy. Much  !

of this work has focused on the characteristics, toxicology and dosimetry of

Professional Experience (continued) uranium metal and uranium oxide aerosols. As a medical physicist, he also provides internal dosimetry for the Division of Nuclear Medicine, University Hospital, the Fred Hutchinson Cancer Research Center in Seattle, the Virginia Mason Medical Center, and NeoRx Corporation for studies on the effectiveness of radiolabeled monoclonal antibodies and other radio-pharmaceuticals used in cancer diagnosis and treatment.

He has managed a number of research projects in his current assignment at Battelle. These include a technical evaluation of quality assurance standards for radiobioassay and whole-body counting, a study of the retention and excretion of uranium ore dust in uranium mill workers, and analysis of the risks of plutonium inhalation in long-term beagle dog studies. Dr. Fisher has served as a technical advisor to the Hanford Internal Dosimetry Program, and currently chairs an advisory panel for the U.S. Nuclear Regulatory Commission reviewing the results of a uranium exposure accident. He is currently involved in a study of the microdosimetry of radon and daughter products in the respiratory tract.

Dr. Fisher is the author of more than 60 scientific papers and reports, and He was also co-editor of edited InhaledCurrent ParticlesConcepts in lung VI (Pergamon Dosimetry Press, )(1983).
