We have reviewed your submittal dated June 5,1987, which contained the statistical justification (that we previously requested)for a particular aspect of your measurement control program, as currently used to satisfy one of the requirements of 10 CFR 70.57(b)(11) and for which you propose continued use under the new requirements of 10 CFR 74.31(c)(3) and (4). We have determined that the limited use of this statistical limit, os currently applied, will not compromise your ability to satisfy the requirements of 10 CFR 74.31(c)(3) and (4) and that its continued use under your existing part 70 Fundamental Nuclear Meterial Control Plan (FNMCP), as described in Section 4.5.3 (items 3 and 4) of such Plan, is permissible during the interim until your new 74.31 FNMCP is finalized.

! With regards to your 74.31 FNMCP, it is our understanding that you will submit I a revised Chapter 5.0 in early July 1987 and all other revised Chapters as I they are completed, but not later than October 30, 1987. Additionally, it should be noted that Section 4.6.2.1 of your new Plan needs to be revised to note the following:

1) Using a four sigma limit as the basis for determining the need to l remeasure or verify previous measurements made during an out-of-control condition shall only apply to those measurement systems (devices) identified (by the code "D") in your June 5th justification submittal. For all other key measurement systems, i

measurements made during an out-of-control condition must either be remeasured (on a 100% basis) or verified (by remeasurement on a last out, first in basis until agreement between the original and remea-suremeat value is obtained.

2) For justification of the above stated practice, a reference to a Chapter 4.0 Annex section should be mentioned in Plan Section 4.6.2.1.

The justification presented in your June 5th submittal should thus appear in your chapter 4.0 Annex.

the provisions of 10 CFR 9.12.
