l Gentlemen:

\\

My letter of February 10, 1989 submitted proposed License Amendments (pursuant to 10CFR50.4 and 50.90) to facility operating licenses NPF-9 and NPF-17 for McGuire i

~

I Nuclear' Station Units 1 and 2, respectively. The proposed; amendments would' allow certain 18 month diesel generator'(D/G) Technical' Specification Surveillance l

currently required te be performed d6 ring unit shutdown to also be able'to.be conducted during unit' operation (i.e. not restricted to specific modes'). The

Register on-March 7, 1989.

l As discussed in the above submittal, the proposed amendments were (or at least a l

certain portion of them) were requested to be approved by May 4, 1989.in order to prevent a forced shutdown of Unit 2 due to the expiration of a Technical Specification Surveillance interval. This surveillance. interval expiration deadline was the result of Duke's failure to perform a periodic test procedure during the last McGuire Unit 2 refueling outage. The'NRC was to be informed of any change in this situation.

Accordingly, please be advised that because of a McGuire Unit 2' trip and subsequent outage on March 3, 1989, Duke was able to perform successfully the subject periodic test procedure.

Consequently, amendment approval by May 4, 1989 l

is no longer needed. While there is no lonBer an approval deadline for the amendments (the T. S. Surveillance can return to their current normal outage l

schedules), the proposed amendments are still desired by Duke and-should be reviewed / approved.via the normal process. This was previously. discussed with Mr.

D. S. Hood of your staff on May 6' 1989.

Should there be any questions'concerning this matter or if additional information is required, contact Bruce Nardoci at (704) 373-7432.

Very truly yours,

-l 0
