.Gentiemen:
This letter is in regards to Section 4.5.3, Items 3 & 4, page 4-14(a) dated August 21, 1985 of your. currently approved Part 70 Fundamental Nuclear Material Control Plan (FNMCP).
We have determined that the approval of "four standard deviations" included as part of your December 9,1983 submittal and as approved by our November 30..
1984 response was in error in that it contradicts the three standard deviation.
requirements of 10 CFR 70.57(b)(11) and the NRC's policy stated in our June 17,
~1983 generic letter.
If you wish to pursue an exception to the requirements of i
10 CFR 70.57(b)(11) it will be necessary to submit a request providing statistical justification under the. provisions.of 10 CFR 70.34.. If approved, we will issue a proper notwithstanding license condition.
If approval is not granted, the current.10 CFR Part'70 Plan will have to be revised to meet the requirements of 10'CFR70.57(b)(11).
In either case, the decision will also apply to the FNMCP required by 10 CFR 74.31(b).
If you choose to pursue the aforementioned exception request it should be forwarded to'us for' review and action.
If you decide to revise the previously l
referenced section of your FNMCP to conform with the requirements 'of 10 CFR 70.57(b)(11) then it should be directed to Region II under the provisions of 10 CFR 70.32(c).
In' either case, your subnittal is to be made no later than May 15, 1987., In the absence of either submittal we will issue a license condition to clarify that the three standard deviation requirements of 10 CFR 70.57(b)(11) prevails over any contrary statements contained in Section'4.5.3 of your FNMCP.
