NOTICE OF DEVIATION (NRC INSPECTION REPORT N0. 70-824/87-01)

This refers to the Nuclear Regulatory Commission (NRC) inspection conducted by.

B. K. Revsin on June 29 - July 1,1987 at Babcock and Wilcox Company's Lynchburg Research Center. At the conclusion of the inspection, the findings were discussed with J. A.. Eanes, Manager, Employee Conmunity and Regulatory Relations. NRC concerns relative to the inspection findings were also discussed on July 14, 1987, in a telephone conversation between Mr. Eanes and E. J. McAlpine of my staff.

The inspection was an examination of activities conducted under your license with respect to radiation safety and compliance with NRC regulations and the conditions of your license. It included selective examinations of procedures and representative records, interviews with personnel, and direct observations i by the inspector. i The inspection revealed no violation of NRC requirements. However, certain .

activities having safety significance appeared to deviate from commitments to the NRC. The deviation and elements to be included in your response are described in the enclosed Notice of Deviation. In addition, the inspection revealed that full corrective action on a previous violation (70-824/86-06-02) had not been taken. The NRC views this failure to take full corrective action as a serious matter. In your reply to the Notice of Deviation referenced above, you should also indicated what actions you have taken to correct this matter and steps taken to prevent recurrence. Failure to resolve this matter may result in additional enforcement action. i The responses directed by this letter and its enclosure are not subject to the clearance procedures of the Office of Management and Budget as required by the Paperwork Reduction Act of 1980, PL 96-511.  :
