On March 3,1989, we met with 'you and members of your staff in .an enforcement - 4 conference to discuss the sequence of events on__ December 18, 1988, regarding  ;

recovery from a reactor trip. Specifically, we discussed the events that led to the: improper withdrawal of the group 3 safety rods which had fallen into the core and your decision to remove the shift supervisor from duty. The event is described'more fully in our Inspection Report No. 50-346/88037 which. ,

was-issued on February 24, 1989. Based on those' discussions we became ,

concerned about the apparent breakdown in the control of licensed activities  !

in the control room which contributed to the event. This letter confirms ,the telephone conversation on March 10, 1989, between Mr. Edward Greenman of this office and Mr. Lou Storz of your staff concerning restrictions placed by .,

Toledo Edison Company on the return to duty of the shift supervisor who was on duty at the' time of the event. We understand that you will provide us with a j written . report describing your basis for returning the stift supervisor to  !

licensed duties when the report becomes available.

Issuance of this Confirmatory Action Letter does not preclude the issuance of an order requiring implementation of the above commitments.
