SAFETY EVALUATION REPORT, RE LETTER OF REQUEST FOR CONSENT DATED SEPTEMBER 3, 1987

Background

By letter dated September 3, 1987, B&W requested consent from the NRC concerning a business arrangement involving B&W's CNFP.

Discussion The arrangement will be the creation of a partnership between a subsidiary of the Babcock and Wilcox Ccmpany (B&W Fuel, Inc.) and a Delaware Corporation in which the shareholders will be U. S. subsidiaries of Framatome S.A., Uranium Pechiney S. A., and Cogema S. A. The partnership will be called the B&W Fuel Company and will be divided so that, through its subsidiary, B&W would retain a 51 percent controlling interest.

In the submittal, B&W states that there will be no changes in the existing health and safety program, activities, plant management direction and technical qualifications, SHM physical protection, procedures. nuclear materials control, emergency plans, or environmental obligations or responsibilities already in place at the CNFP.

The licensee of the CNFP will continue to be financially qualified. B&W will provide or arrange to have provided adequate financial qualification assurances for the B&W Fuel Company until such time as the B&W Fuel Company can independently provide such assurances.

B,abe'ock and Wilcox, SER 2 007 1 9 1987 Conclusion / Findings The staff finds that the proposed transfer of the license to the B&W Fuel Company is in accordance with the provisions of the Act and will have no adverse effect on the public health and safet;/ or on the environme,1t. In addition, the staff has determined that the requirements of 10 CFR 70.23(a) will continued to be fulfilled. Consent for the transfer of Materials License No. SNM-1168 is recommended.
