DOCKFTS 50-266 AND 50-301 TECFNICAL SP, EDIFICATION CHANGE REQUEST 119 FISSIONABLE MATERIAL LIMITATIONS FOR NEUTRON FLUX DETECTORS POINT BEACH NUCLEAR PLANT In accordance with the requirements of 10 CFR 50.59 and 50.90, Wisconsin Electric Power Company (Licensee) hereby submits an application for amendments to Facility Operating Licenses DPR-24 and DPR-27 for Point Beach Nuclear Plant, Units 1 and 2.

The purpose of these amendments is to delete Specification 15.5.3.A.8, which provides limitations on the amount of fissionable material which may be used in the form of neutron flux dotectors at the Point Beach site.

Attached is the affected Technical Specification page with the deletion identified by a margin bar.

Deletion of Specification 15.5.3.A.8 is consistent with NRC guidance and will provide compatibility with the conditions of the operating licenses for Units 1 and 2.

By letter dated December 16, 1974, the Atomic Energy Commission provided guidance for relaxation and simplification of the licensing of byproduct, source, and special nuclear materials.

It also provided a standard license format with general provisions for receipt, processing, and use of these materials.

Subsequently, on September 8, 1975, we applied for amendments to our operating licenses for Units 1 and 2 to incorporate this hD 8710200370 971013 I

guidance and supplemented this~ submittal with a letter dated January 30, 1976.

The NRC issued Amendment 15 to DPR-24 and-knendment 20 to DPR-27 on March 17, 1976.

Among other changes, Paragraph 2.3 of the operating license was amended to read:

" Subject to the conditions and requirements incorporated i

herein, the Commission hereby licenses... pursuant to the Act l

and 10 CFR Parts 30, 40 and-70 to receive, possess and use at any time any byproduct, source, and special nuclear material as sealed neutron sources for reactor startup, sealed sources'for reactor instrumentation and radiation monitoring equipment calibration, and as fission detectors in amounts as required."

continuing to specify a limiting quantity of fissionable material in the form of fabricated neutron flux detectors in the Technical Specifications is inconsistent with Amendments 15 and 20 to the Units 1 and 2 licenses.

Failure to delete Specification 15.5.3.A.8 at that time was an oversight which this proposed amendment will correct.

We have examined this license amendment application and Technical Specification Change Request with respect to the criteria of 10 CFR 50.92 and have determined that this amendment will not result in a significant hazards consideration.

The first criterion concerns changes involving a significant increase in the probability or consequences of an accident previously evaluated.

This change request is a deletion of a requirement which is consistent with Commission guidance and provisions of the operating licenses.

As no physical plant alterations result from this change, and requirements are not relaxed, there can be no change in the probability or consequences of an accident previously evaluated.

The second criterion involves creating the possibility of a new or different kind of accident from any accident previously evaluated.

Again, as stated above, since no physical change has been made, nor has any requirement been relaxed, this possibility is precluded.

The third criterion concerns a significant reduction in a margin of safety.

Margin of safety is not reduced by this deletion as Operating License Paragraph 2.C has been, and will continue to be, the condition to which we conform.
