Response to NRC Bulletin Number 88-10, Nonconforming Molded-Case Circuit Breakers and request for Relief from Certain Actions Required (TAC Number 71286)

Centlement Nuclear Regulatory Commission (NRC) Bulletin Number 88-10, Item 1, requires licensees to identify all molded-case circuit breakers (CBs) purchased prior to August 1, 1988, that are being maintained as stored spares for safety-related (Class IE) applications and verify the traceability of the CBs.

Item 3 requires licensees to test the CBs that are not traceable to the CB manufacturer.

Toledo Edison (TE) has identified 84 molded-case CBs that vere being maintained as stored spares for use in Class IE equipment and determined 78 vere purchased directly from the Circuit Breaker Manufacturer (CBM).

Toledo Edison has not been able to verify traceability of the remaining six CBs, which are presently on hold pending outcome of this request. These CBs were purchased from Bailey Metering Company in 1976 as spare parts to the Bailey Metering Company equipment used in the Reactor Protection System. The original manufacturer of four of these breakers was Airpax Electronic. The remaining two vere manufactured by Heinmann Electric Company. The model numbers are as follovs:

1) Airpax Electronic Model UPL 11-2688-6
2) Airpax Electronic Model UPL 3-2688-24
3) Heinmann Electric Catalog Number 70-399-2 Bailey was able to determine that, at the time of the TE purchase order for the six breakers, it was purchasing parts directly from Airpax Electronic and Heinmann Electric Company. However, due to the time that has transpired since s903100022 890224

Serial Number 1-863 Page 2 TE's purchase (1976), Bailey can not provide documentation linking the Toledo Edison Purchase Order to either company. The Bailey part numbers for these six breakers are now obsolete.

Toledo Edison hereby requests relief from the Item 3 testing requirements of the Bulletin for these six breakers based on the following:

1) The six spare breakers vere purchased during the same time period as the originally installed breakers.

2) None of the originally installed breakers have failed in 13 years of operation.
3) As stated in the bulletin, the concerns do not apply to electrical equipment (safety-related and commercial grade) originally installed in plants.
4) The six spares were purchased from the same reputable vendor (Bailey Metering Company).
5) These six breakers can not be easily replaced.
6) The initial cost of the six spare breakers was in the tens of do}1ars.

Toledo Edison believes that the above information provides the basis for concluding, with reasonable assurance, that the six spare CBs vill parform their intended safety function. Toledo Edison considers this a final response contingent upon approval of the requested exemption.
