SENTENCING OF FORMER YOH SECURITY INC. EMPLOYEES s
On July 15, 1987, two former Y0H Security Inc., (Y0H) employees, who were indicted along with YOH by a Federal Grand Jury in Sptember,1986 in Philadelphia, Pennsylvania, and convicted in April,1987, were sentenced. The convictions resulted from being found guilty of charges of falsifing training records for the security fdrce at the Limerick Generating Station prior to the NRC's issuance of an operating license for the facility. A third individual who provided weapons training under contract to Y0H, and who was indicted at the same time, was found innocent of all charges in April.
One of the former employees, who was the Site Manager at the time of the falsification occurred, was sentenced to six months in prison and fined $30,000. The other employee who was the security force Captain at the time, was placed on probation,for five years. He had pleaded guilty to the charges and was a key government witness in the trials.
The U.S. District Judge, in handing down the sentences, stated that the falsification of training records had tainted the integrity of the nuclear industry. The Assistant U.S.
Attorney who prosecuted the government's case said that anything less than incarceration would have sent the wrong message to the nuclear industry. The attorney for the former YOH Site Manager said that he would appeal the sentence on the grounds that it was a nonviolent, victimless crime.
This Preliminary Notification is issued as a follow-up to PNS-I-86-15 and PNS-I-87-04 and is considered by Region I to close this matter.
It is current as of 11:00 a.m., July 16, 1987.
Region I received notification of the sentencings from the U.S. Attorney's office for the Eastern District of Pennsylvania. The Commonwealth of Pennsylvania has been informed.
