Inspection No. 70-687/89-01 This refers to the routine safety inspection conducted by Mr. J. Roth of this office on January 9-12,.1989, at the Sterling' Forest Research Center, for the purpose of reviewing'the~ licensed program at your facility. Areas examined during this inspection are described in the NRC Region I Inspection' Report whi.ch-is enclosed with this'1etter. Within~these areas, the inspection consisted of selective examination'of procedures and representative records, interviews with personnel, and measurements and observations by the inspector.

' Five violations of NRC requirements were identified. You are required to reply to these matters in accordance with the enclosed Appendix A. That reply.is not subject to clearance by the Office of Management and Budget under the Paperwork .

Reduction Act'of 1980, PL 96-511. However, three of the five violations

' identified, concerning posting of radiation' areas in accordance with 10 CFR 20.203, posting of all the documents required by 10 CFt 21.6 and maintenance of documentation of the 7A Type'A container tests as required by 49 CFR 173.415(a), were corrected prior to the end of this inspection. These violations were reviewed and..found to meet the mitigative tests described in 10 CFR 2, Appendix C; consequently, these violations were~not discussed in the Notice of Violation enclosed with this letter. The establishment and imple-mentation of your long-term corrective actions for these violations will be-reviewed during a subsequent inspection.

During,the inspection, the inspector noted that you had not installed a fence on the north' side of the property to restrict access to the Waste Storage Building as committed to in your letter dated September 14, 1988. That letter was sent in response to our August 22, 1988 letter which presented a violation in Appendix A Item A with regard to excessive radiation on the east external wall of the Waste Storage Building that could result in an individual receiving a dose in excess of 2 millirems in one hour and 100 millirems in seven conse-

-cutive days. Included with your response to the above violations, you are required to provide the actions you will take to either restrict access to the Waste Storage Building or to assure that the radiation dose on the external surfaces of the Building will be limited to less than two millirem in one hour and less than 100 millirem in seven consecutive days. It is of particular concern to us that the corrective actions that were committed to in your September 14, 1988 letter as a result of this violation of regulatory requirements were not carried out. Cintichem, Incorporated 2 FE9 2 71999 actions had been dropped or what new corrective actions were proposed. Future enforcement action may be required on this matter at a later date.

During examination of the Gamma Pit it was observed that the NRC authorized array of waste storage containers was full and that there was another NRC authorized array of spent fuel assemblies placed in proximity to the full array in an arrangement not previously approved or evaluated. We are concerned that this was allowed to occur without appropriate evaluation of potential interactions between the two arrays. We request that you provide us your evaluation and supporting data of the new storage arrangement within 45 days of the date of this letter.

In addition, the enclosed Inspection Report documents oral commitments (see paragraph 9) with regard to the June 30, 1988 Confirmatory Action Letter No. 88-15 that were made by licensee representatives and discussed in the exit interview. If your understanding of these commitments differs from the statements contained in the report, please inform this office promptly.
