This testimony addresses the various contentions raised in this proceeding concerning Letters of Agreement (LOAs) for Revision 2 of the New Hampshire Radiological Emergency Response Plan (NHRERP).

Contentions have been raised noting that the New 1

Hampshire Towing Association letter of agreement of November 27, 1985 contained in NHRERP was unsigned and that its content merely provided for a " general willingness" of the organization to provide emergency towing services as needed 0710080132 871001 PD3 ADOCK0500gg3 j

l-h and does not reflect a commitment of specific numbers of vehicles and drivers.

The letter of agreement with the New Hampshire Towing i

i Association included in NHRERP Volume'5, Revision 2 of the NHRERP (Rev. 2) has been' signed by the appropriate parties.

In the December 1986 RAC review of Revision 2 it was determined that the deficiency in the NH Towing Association agreement had been adequately corrected.

There are currently 19 letters of agreement with towing companies consenting to provide approximately 50 towing vehicles with respective drivers and crews as needed (see Attachment 1 for all towing company LOAs obtained since Rev. 2).

These current letters of agreement with towing companies provide resources in excess of the recommendations for six tow trucks for the New Hampshire portion of the EPZ as set forth in Section 12 of Volume 6 of the NHRERP and as discussed in the testimony of the ETE and Human Behavior Panel.

In addition, the majority of the tow truck providers are based at locations at or near the perimeter of the EPZ (i.e., Dover, Durham, Epping, Exeter, Greenland, Newfields, Newington, Newton, Plaistow, and Portsmouth) thus ensuring that tow vehicles responding to a call would be traveling on incoming lanes and not those designated for the opposite flow of evacuees leaving the area.

5 of the NHRERP in'no way invalidates this compact.

The agreement is a legislative act which has been approved by,the legislatures and governors of the respective party states.

The compact became official and was signed into law as described in Article 1 of the NEIRAP, and it continues to be recognized as such.

Similarly, the New England State Police Compact is a ratified compact enacted into law by the appropriate legislative bodies, and remains in effect as defined in the compact.

Allegations have been made with respect to other LOAs which are not included in NHRERP.

These are addressed as follovs:

A letter of agreement between New Hampshire Yankee Division of Public Service Company of New Hampshire and the State of New Hampshire has been executed and is also found in Volume 5.

The Commonwealth of Massachusetts is currently not participating in emergency planning for Seabrook Station, and consequently no representative of the Commonwealth has signed this letter.

However, the agreement between New Hampshire Yankee and the State of New Hampshire remains in force.

The availability and willingness of the United States Coast Guard to aid in an emergency response is documented in the Memorandum of Understanding executed between the Coast Guard and the Director, NHCDA, which was signed on November 6,

1986.

The State can~ request federal assistance through FEMA.

q FEMA will then allocate' resources as necessary under the Federal Radiological Emergency Response Plan (FRERP), 50 Fed.

Reg. 46542, November 6, 1985.

Since Pease Air Force Base and Portsmouth Naval Shipyard are federal (Department of Defense) establishments, FRERP obviates the need for any other agreements.

The Rockingham County Dispatch Center is a facility owned and operated by a governmental entity (Rockingham County) and therefore no letter of agreement for the Dispatch Center is required.

Nevertheless, Volume 5 of the NHRERP contains a letter of agreement with the Rockingham County Sheriff's Department whereby the department agrees to provide the State with communications assistance in an emergency.

A letter of agreement has been executed between the State and the Federal Aviation Administration and is included in Volume 5.

Since New England Telephone is not assigned any specific responsibilities in the NHRERP, no letter of agreement is required with it.

All Reception Centers identified in the Host Community plans (volumes 33, 35, 36, and 38 of the NHRERP) are public facilities operated by political subdivisions of the State of New Hampshire.

The American Red Cross (ARC) is responsible for providing mass care to those evacuated from the plume exposure EPZ.

A written agreement between the ARC and the State of New Hampshire is included in Volume 5 of the NHRERP. I i

The December 1986 RAC review of the plan found that the ARC letter of agreement adequately demonstrates an ability to open and staff planned Mass Care Facilities.

No letters of agreement are required with any public facility designated in the plan as a mass care facility.

A letter of agreement will be obtained from every private facility designated for mass i

care.

Most recently, letters of agreement with the Salem Boy's and Girl's Club and Squamscott Home Health, Inc., Dover have been obtained (see Attachment 3).

The ARC is currently working to obtain letters of agreement with Rochester Catholic High School in Rochester and St. Thomas Aquinas High School in Dover.

All required letters of agreement in Salem have been signed.

All Mass Care Facilities in Manchester are public facilities and require no letter of agreement.

The Rochester Host Plan (Volume 35) lists the Salvation Army building as a Mass Care Facility.

The use of this facility is ensured through a national " Statement of Understanding Between the Salvation Army and the American National Red Cross," (9/75) (see ).

Letters of agreement with Host Care Facilities have been obtained for all Special Facilities in the EPZ.

Letters of agreement with the following Host Care Facilities have been obtained since Rev. 2 of the NHRERP (see ): Clipper Home of Wolfeboro (for Goodwins of Exeter); Clipper Home of Rochester (for Clipper Home of l J

o Portsmouth); McKerley Health Care Center -

Derry, Inc. (for Eventide Home); Maple Leaf Healthcare, Villa Crest and Maple Leaf, Inc. (for Seacoast Health Care, Inc.).

No other Host Health Care facility letters are outstanding.

The accessibility of adequate EMS or ambulance service required to implement the NHRERP is sufficiently ensured through the letters of agreement contained in Volume 5, each of which lists the number of vehicles and' personnel I

available.

These letters make available 67 vehicles, 49 of which are life support units (ambulances).

(The letter of agreement with O'Brien Ambulance, Inc. will be deleted from Vol. 5.)

This is in excess of the total of 36 required for New Hampshire, as listed in the IFO Resources Coordinator's procedure, Volume 4, Section 18, Attachment 18B.

The remaining 18 units are wheelchair vans.

These letters also make available at least 129 Emergency Medical Technicians, significantly more than required to man the number of emergency medical vehicles needed.to implement the NHRERP.

Procedures for the mobilization and deployment of these vehicles and personnel are discussed in the testimony of the Special Needs/ Transportation Panel.

There are more than a sufficient number of bus and driver pairs to implement an entire EPZ-wide evacuation provided by the bus companies with whom letters of agreement l

have been obtained, as discussed in the testimony of the l-Special Needs/ Transportation Panel.

back-up drivers has been identified.

This pool consists

.primarily of New Hampshire Department of' Transportation and National Guard personnel..It is further supplemented by a letter of agreement with the Teamsters Union.. To date, agreements have been obtained from 9 transportation companies representing about 48 drivers.-

-OMNE Partners II no longer owns the OMNE Mall location for a state transportation staging area.

The new owner of the mall, the Flatley.Ccmpany, tentatively has-agreed to allow the site to be used as a' State Transportation Staging Area, subject to terms to be negotiated.

The areas specifically designated for staging area use are the parking lot.and access roads.

This is in consonance with the NHRERP procedure foi the State Staging Area, which does not utilize the mall building itself, only the surrounding parking areas and access roads.

In the event of an emergency in which the State requires supplemental driver support, Custom Carriers Ltd. and the shop stewards will be contacted directly by the Teamsters Local 633 management regarding the number of drivers needed, along with the necessary information as to where they are to report.

The New Hampshire Civil Defense Agency will provide training as necessary to facilitate implementation of tnis agreement.
