Thank you for your letter of September 8,1987, replying to the Notice of Violation transmitted by our letter of July 29, 1987.
We have reviewed your response to Violation 1 concerning radioactive sludge disposal. The arguments you advance for rescinding the citation rest mainly on assumptions regarding the applicability of 10 CFR 20.303 which governs sanitary sewage disposal and on the low levels of radioactivity present in the sludge.
However, the citation was not issued for sewage system disposal but for land disposal of licensed material removed from your onsite sewage treatment facility.
Such disposal is contrary to the requirements of 10 CFR 20.301 unless prior authorization is requested and received pursuant to 10 CFR 20.302.
The citation in this matter is reaffirmed. However, we do concur with your assertion that this matter is without great safety significance and agree that the Severity Level should be reclassified from IV to V.
This matter was discussed by telephone with Messrs. J. Zach and E. Lipke of your staff on September 28, 1987.
With regard to your response to violations 2.1 and 2.2, we have no further questions at this time.
Your corrective actions will be reviewed during subsequent inspections Thank you for your cooperation.
