NOTICE OF VIOLATION Illinois Power Company Docket No. 50-461 Clinton Fower Station License No. NPF-62 As a result of the inspection conducted on December 6,1988, through January 27, 1989, and in accordance with 10 CFR Part 2, Appendix C - General Statement of Policy and Procedure for NRC Enforcement Actions (1988), the following violation was identified:

Technical Specification 3.8.1.1. required that three separate and independent diesel generators be OPERABLE in OPERATIONAL CONDITIONS 1, 2, and 3. ACTION d of that Specification required in part that, with diesel generator 1C inoperable, restore the diesel. generator to OPERABLE status within 72 hours8.333333e-4 days <br />0.02 hours <br />1.190476e-4 weeks <br />2.7396e-5 months <br /> or declare the HPCS system inoperable and take the ACTION required by Specification 3.5.1. ACTION c of Specification 3.5.1 required in part that, with ECCS Division III (HPCS) inoperable, restore the inoperable division to OPERABLE status within 14 days or otherwise be in at.least H0T SHUTDOWN within the next 12 hours1.388889e-4 days <br />0.00333 hours <br />1.984127e-5 weeks <br />4.566e-6 months <br /> and in COLD SHUTDOWN within the following 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br />.

Contrary to the above, from. initial plant startup on February 27, 1987, until November 11, 1988, the 1C diesel generator was inoperable because it did not meet its design basis as stated in 10 CFR 50, Appendix A, General Design Criteria 2, which required that safety systems be designed to withstand the effects of natural pheromena without loss of capability to meet their safety function. During the time period above, a rupture disk was left installed in the exhaust line of the diesel generator which could have prevented the diesel from performing its safety function after tornado missile damage to the exhaust line. The plant was operated extensively in OPERATIONAL CONDITIONS 1, 2, and 3 during that time period, including several. periods longer than the allowed ACTION times of Specifications 3.8.1.1 ACTION d and 3.5.1 ACTION c.

Operation of the plant in OPERATIONAL CONDITIONS 1, 2, and 3 with the 1C diesel generator inoperable as described above is a Severity Level IV violation (Supplement I) (50-461/88030-01(DRP)).

Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written statement or explanation in reply, including: (1) the corrective actions that have been taken and the results achieved; (2) the corrective actions that will be taken to avoid further violations; and (3) the date when full compliance will be achieved. Consideration may be given to extending your response time for good cause shown.
