RESPONSE TO MAY 8 AND 13, 1987 LETTERS REGARDING HATCH NUCLEAR PLANT This acknowledges receipt of your responses dated May 8 and 13, 1987 to the Notice of Violation and Proposed Imposition of Civil Penalty issued on April 8, J

1987 and your check for $50,000 in payment of the proposed civil penalty.. In your responses, you addressed the violations and requested mitigation of the civil penalty associated with Violation I based upon:

(1)yourprompt,com-petent, extensive, and comprehensive corrective and mitigative efforts following the partial loss of the spent fuel pool inventory, and (2) your prompt reporting of the spill event, including your ongoing written and oral updating of the NRC and your coordination with the State of Georgia.

I In our April 8,1987 letter forwarding the Notice we acknowledged that the corrective actions taken to reduce the radiological consequences of the event were excellent. We also acknowledge your prompt reporting.

However, as indicated in our letter, the violation demonstrates a lack of management insistence on procedural adherence, attention to detail, and the complete I

evaluation and resolution of plant deficiencies.

This was evidenced by the failure of plant personnel to take advantage of several opportunities to prevent the event from occurring and t.o mitigate the loss of fuel pool water.

Previous violations in the areas of procedural adherence, attention to detail, and complete evaluation and resciution of plant deficiencies indicate prior poor performance in these areas.

These violations were documented in NRC i

Inspection Report Nos. 50-366/86-32, 50-321/86-12, 50-321/86-08 and reflected in the last Systematic Assessment of Licensee Performance report which was issued on March 4, 1987.

In light of these factors, we have concluded that no adjustment of the base civil penalty amount has been deemed appropriate.
