SUBJECT:
STATUS OF BILLIE CARDE SUBPOENA I
l The Stello subpoena to Billie Garde was issued on May 20, 1987.
She filed a I
motion to quash on June 1,1987, citing as grounds:
(1) compliance with the subpoena would compromise public health and safety (2) Stello had no authority to issue the subpoena (3) the information possessed by Ms. Garcie was protected by the attorney client privilege Contemporaneously with the motion to quash, Ms. Garde filed a petition requesting that the _ Commission establish an independent investigative unit to deal with 500 allegations which GAP claims to have received regarding the South Texas facility.
The petition specifically requested that neither Stello nor anyone from Region IV have anything to do with investigating the allegations.
OGC H-St is dealing with the petition.
I Our response to the CAP motion was filed on June 11, 1987. We are informed that the Commission has scheduled an affirmation session for next Wednesday, l
July'15 at 11:30 a.m.
