Dear Mr.. David:

This will acknowledge receipt of your license application dated January 20, 1989 for the export of a. civilian nuclear power plant to the People's Republic of China.

Inaccordancewiththerequirementsof10CFR110.41(a)theapplicationwas forwarded to the Executive Branch for review on January 27, 1989; also, a copy of the. application was placed in the NRC's Public Document Room and noticed in the Federal Register (54 F.R. 5291, February 2,1989), in -

accordance with the requirements of 10 CFR 110.70.

As you correctly noted. in your application, the U.S./PRC Agreement for

. Cooperation has not.been implemented. Exports of nJClear reactors are subject to the comprehensive export criteria in 6110.42(a)and,therefore, a license cannot be issued until the Agreement for Cooperation is in force and all export criteria are met. As we discussed, it is our under-standing that you w'11 be submitting a separate export license application

'for the fuel for this plant.
