Dear Ms. Bauman:

This letter responds to your June 11, 1987 appeal of the agency's May 14, 1987 denial of documents in response to F0IA 87-226 for records of investiga-tions-of kickbacks or other improprieties regarding former NRC employees now working for TERA, including an October 1986 'incident at Crystal River nuclear plant.

The agency withheld the document listed on Appendix A (see attachment) under F0IA Exemption 7(A) (5 U.S.C. 552(b)(7)(A) and 10 C.F.R. 9.5(a)(7)(1)).

I affirm that initial agency decision for the following reasons. The withheld information was compiled for law enforcement purposes, and the disclosure of it could reasonably be expected to interfere with enforcement roceedings. See NLRB v. Robbins Tire & Rubber Co., 437 U.S. 214, 222-223 p(1978) . Release of this information could allow those being investigated to learn the scope, direction, and focus of investigatory efforts, and thus could possibly allow them to take action to shield potential wrongdoing or a violation of NRC requirements from investigators. Furthermore, the Office of Inspector and Auditor has verified that the investigation which is the subject of the Appendix A document is ongoing and release of the document would harm the ongoing investigation.

This letter represents final agency action on your June 11, 1987 F0IA appeal.

Judicial review of the denial of documents is available in Federal District Court in the district in which you reside or have your principal place of business, or in the District of Columbia.
