GLOBAL NUCLEAR FUEL - AMERICAS LLC: REVIEW OF THE MINIMUM MARGIN OF SUBCRITICALITY FOR UP TO 8 WEIGHT PERCENT ENRICHMENT OF URANIUM - 235 AND AMENDMENT 16 (ENTERPRISE PROJECT IDENTIFIER L-2020-LNS-0002)

Dear Mr. Murray:

By letter dated June 23, 2020 (Agencywide Documents Access and Management System

[ADAMS] Accession No. ML20175A206), you requested the Nuclear Regulatory Commission (NRC) staff to review your minimum margin of subcriticality (MMS) for enrichments up to 8 weight percent uranium (U) - 235. The NRC staff accepted the submittal for formal review via letter dated July 1, 2020 (ADAMS Accession No. ML20175A233). By letter dated July 28, 2020 (ADAMS Accession No. ML20210M309), you responded to our request for additional information (RAI) letter dated July 15, 2020 (ADAMS Accession No. ML20196L660).

Based on the review and your responses to our RAIs, the staff concludes that your MMS for use up to 8 weight percent uranium (U) - 235 is acceptable. This report does not provide any conclusions regarding the physical possession and/or processing of special nuclear material in excess of current possession limits. Safety Condition S-1 has been revised to include the date of your June 23, 2020 submittal, and the July 28, 2020 responses to RAIs. Pursuant to Title 10 of the Code of Federal Regulations (10 CFR), Part 70 of Materials License SNM-1097 is hereby amended to include the approved analysis and validation techniques provided in your submittal.

Enclosed is a Safety Evaluation Report to document the review. The amendment is approved.

Also enclosed are public and non-public versions of Amendment 16 to the SNM-1097. The Enterprise Project Identification Code is considered closed.

In accordance with 10 CFR 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Documents transmitted herewith contain Security-Related Information. When separated from the sensitive conditions in Enclosures 3 and 4, this document is decontrolled.
