SAFETY EVALUATION REPORT: AMENDMENT REQUEST DATED JANUARY 29,1998, DELETION OF GA'S FUSION EXPERIMENT FACILITIES AND SURROUNDING AREA FROM SNM LICENSE BACKGROUND General Atomics (GA) has requested the deletion of the Fusion Experiment Facilities and surrounding areas from Materials License SNM-696 by letter dated January 29,1998, as j
" authorized places of use." GA currently has a Possession Only License and submitted a site decommissioning plan in September 1996. The Fusion Experiment Facility is included within j
the state license (Number 0145-37) and GA is conducting activities at that facility that are the sole jurisdiction of the State of Califomia.
DISCUSSION General Atomics is located approximately 22 km (13 miles) north of downtown San Diego, j
Califomia. The site has two broad scope radioactive materials licenses. Both licenses describe the " authorized place of use" simply as 3550 General Atomics Court. The facility consists of two areas: (1) the Main site, which included the research and development (R&D) labs, waste-i processing facilities, the TRIGA reactor, and fuel fabrication processing; and (2) the Sorrento Valley site where high temperature, gas-cooled reactor (HTGR) fuel was produced. GA conducted operations under Materials License SNM-696, until September 1995, when it ceased all authorized activities. Currently, the only authorized operations taking place at the site are those involved in the decommissioning processes, with the exception of the fusion experiment facility and other activities specific to the state license. The Fusion Experiment Facility is located at the Sorrento Vauey site and there were no operations associated with Materials License SNM-696 conducted at this site. The Fusion Experiment Facility continues to operate under the state license.
GA has previously received a release for unrestricted use portions of both the Main site and the Sorrento Valley site that have been considered "non-impacted" by operations but had been included through the nature of the " broad scope" wording of the license. See the attached map for the exact location of the fusion facility.

2 cdtegorically excluded from the requirement to prepare a site-specific environmental assessment. Therefore, in accordance with 10 CFR 51.22(c)(11), neither an environmental assessment nor an environmental impact statement is warranted for this action.
CONCLUSIOB:
The staff concludes that there is reasonable assurance that GA's request to remove the Fusion Experimental Facility from the NRC materials license meets regulatory requirements and constitutes no impact upon the health and safety of the public and common defense and security.
The Region IV inspector has no objection to the proposed action.
