Dear Mr. Gaskin:

As you are aware, General Atomics' (GA's) special nuclear material license (number SNM-696) and its State of Califomia broad scope radioactive materials license (number 0145-

37) both describe the " authorized place o' use" simply as "The licensee's San Diego, California site at 3550 General Atomics Court." However, now that GA's SNM-696 license has been amended to authorize possession only, while its State of Califomia license has not, it is important that GA's NRC license be revised to address the fact that certain portions of its site and/or facilities have been, are being, and will continue to be, used in conducting activities under the sole jurisdiction of the State of California. That is, certain portions of GA's site and facilities need to be deleted from its SNM license as " authorized places of use" while remaining as such under its State of Califomia radioactive materials license.

One such portion of GA's site is the area where GA's magnetic confinement fusion experiment is located. The licensed activities and materials used on this portion of GA's site, have always been and will continue to be under the sole jurisdiction of the State of California.

This area, referrad to herein as the " Fusion Site,"is part of GA's Sorrento Valley site and is shown as the cross-hatched area on the attached figure where it is described as being the " Area where licensed materials and machines are under exclusive jurisdiction of State of California "

The " Fusion Site" includes: the building housing GA's magnetic confinement fusion experiment (i.e., building no. 34), the various buildings and structures housing related support systems, offices, warehouses, etc. (e.g., buildings 34-1,34-2,34-3, and 34-4), plus the associated surrounding land area.

NRC licensed special nuclear material has never been used or stored on the Fusion Site. Further, it is isolated from, and has not been impacted by, the use or storage of special nuclear material on other portions of GA's site. In fact, it should be noted that all of the land areas directly abutting the Fusion Site consist cf land areas that were non-impacted and have g'

been previously released to unrestricted use, or are non-GA property. This can be more clearly and specifically defined by referri :g to the attached figure and the numbers denoting different fCgL i

Mr. Charles E. Gaskin, U.S. NRC January 29,1998 696 2864 Page 2 points along the perimeter of the Fusion Site. The segment of the perimeter line extending from point 1 - to - point 2 - to point 3 separates GA's site from non-GA property (e.g., city streets).

The segment of perimeter line extending from point 3 - to - point 4 to - point 5 separates the Fusion She from a portion of non-GA land that at one time was e part of GA's site, but was released to unrestricted use in 1988 (Ref.1). Finally, the segment cf the perimeter line extending from point 5 to point 1 separates the Fusion Site from a non-impacted portion of GA's site that was released to unrestricted use in 1997 (Ref. 2).

GA heraby requests that the purzion of its site referred to as the " Fusion Site," and as shown on the attached map, be deleted from its special nuclear material license. The Fusion Site and t'le activities performed thereon involving the use of radioactive materials and/or radiation mghines will continue to be under the jurisdiction of GA's State of California broad scope radioactive materials license number 0145 37.
