WITHDRAWAL OF COMMITMENT REGARDING TN-40 CASK FABRICATION Dear Mr. Sorensen This is in response to your letter dated December 16,1997, in which you requested withdrawal of a Northern States Power Company (NSP) commitment related to tha Notice of Violation issued as a result of a Nuclear Regulatory Commission inspection Specifically, you requested withdrawal of the corrective action to prevent recurrence of a violabon idenbfied during the NRC inspection performed at an NSP vendor, PX Engineering Company (PXE), on December 13-15, 1994. NSP responded to this violation in a letter dated February 23,1995, with a commitment to have an NSP (or Transnuclear) reprocentative present at all future resin pours for fabrication of the TN 40 dry spent fuel storage cask. However, yourjustificabon for deleting the commitment was not clearty delineated in your December 18 letter.

In your December 16 letter, you state that the reason for deleting the commitment is that NSP is planning to use a different fabricator tht.n PXE for the next five casks However, you did not indicate whether NSP had performed a vendor qualification audit of this now vendor and mamanand the resin pour capabilities and quality control of fabrication processes for adequacy.

In addition, you state that the NSP contract with this new vendor allows for continuous on-site oversight of fabrication activities, however, you did not indicate what level of NSP oversight will be actually implemente(

Please aJ Tess the above issues so that we can evaluate your request to delete the NSP vendor oversight commitment for TN-40 fabrication activities at the new vendor. in addition, please clarify the level and scope of the NSP TN-40 fabncation vendor oversight program.
