Dear Mr. Wood:
By letter dated February 26,1998, and the attached Framatome Technologies incorporated (FTI) affidavit executed by Joseph J. Kelly dated February 26,1998, you submitted an application for amendment to the Davis-Besse Nuclear Power Station, Unit No.1, Technical Specifications (TSs). This amendment would allow the use of the repair roll process for repairing steam generator tubes with defects within the upper tube sheet region. In your letter, you requested that the attached FTl Topical Report BAW-2303P, Revision 3, "OTSG Repair j
Roll Qualification Report," dated October 1997 be withheld from public disclosure pursuant to i
l A nonproprietary version of the FTl Topical Report was submitted on March 13,1998.
FTl stated that the submitted information should be considered exempt from mandatory public disclosure for the following reasons:
1.
The information reveals data or material conceming FTl research or development plans or programs of present or potential competitive advantage to FTI.
2.
The use of the information by a competitor would decrease his expenditures, in time or resources, in designing, producing or marketing a similar product.
3.
The information consists of test data or other similar data conceming a process, method l-or component, the application of which results in a competitive advantage to FTI.
l We have reviewed your application and the material in accordance with the requirements of 10 CFR 2.790 and, on the basis of your statements, have determined that the submitted information sought to be withheld contains proprietary commercial information.
Therefore, the version of the submitted information marked as proprietary will be withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.
