January 14, 1998 U. S. Nuclear Regulatory Commission Attention:

Document Control Desk Washington, D.C.

20555 Gentlemen:

Subject:

Docket Nos. 50-361, and 50-362 10 CFR 140.6 Report, Andrew Keltesch Suit

{

San Onofre Nuclear Generating Station Units 2 and 3 Pursuant to 10 CFR 140.6, this submittal provides the required report for a claim involving alleged personal injury arising out of, or in connection with, the use of radioactive material at the San Onofre Nuclear Generating Station, Units 2 and 3 (SONGS).

Andrew Keltesch and Jodi Kay Keltesch, his wife, have filed suit claiming

(

personal injury and general damages.

They allege that he suffered unspecified j

" severe personal injuries," and she suffered " loss of consortium."

Mr. Keltesch, an employee of Bechtel Construction, worked at SONGS for 7 months in 1995 as an ironworker.

The suit was filed against Southern California Edison Co. in the Superior Court of California, County of San Diego. The case was removed by Edison to the United States District Court for the Southern District of California.

Edison believes that the suit is without merit because Mr. Keltesch's measured exposure while at SONGS was well within the federally allowed limits for radiation workers.
