I have received the stafi's response dated July 2<,1997, to Commissioner Dieus' questions regarding SECY-97-134. Please see my " Negative Consent" comments as follows:
I have no objection to the staf"s recommendation ofimplementing Altemative 3 at the present ti'ie. In tesolving this issue of commercial use of codes by foreign organizations, the stafT should look beyond the thermal-hydraulic codes to include other codes that may or will beTaced with the same issue.
A wider intemational distribution and application of the thermal hydraulic codes and uher codes could enhance world-wide nuclear safety. Therefore, for the longer term, the suff should explore with the Executive Branch the pros and cons of further lifting of the restrictions on commerci11 use of the codes by foreign orpnizations (Altemative 1). Any future options presented to the Commissiori should ensare that there are consistent polici.n among the government agencin. This should be done taking into consideration the intellectual property rights protection and in consultation with the Office of the Intemational Trade Representative.
