APPLICANT'S RESPONSE TO CANT'S COUNTER MOTEON TO STRIKE Intervenor, Citizens Against Nuclear Trash
(" CANT"),
has sought to strike Proposed Findings 2.3.3.3 and 2.3.3.2 of Louisiana Energy Services, L.P.
(" Applicant") because CANT claims they are redundant of paragraph 2.3.3.12.
It is Applicant 's view that a motion to strike is not appropriate in these instances inasmuch as the subject matter of the motion to strike is proposed findings rather than testimony.
The Board is in the best position to review the cited paragraphs and determine for itself which, if any, should be relied upon.
