Given the significance of the revised 10 CFR Part 20 rule to both NRC and Agreement  !

State programs, NRC undertook a review of all Agreement State final Part 20 equiva'ent

(

rules for compatibility with 10 CFR Part 20. The review was conducted as a two step  :

process. The first step involved a review by Oak Ridge National Laboratory (ORNL), under l contract with NRC, to identify any differences or inconsistencies between 10 CFR Part 20 b and each Agreement State equivalent rule. A copy of the two volume ORNL report, dated 2 October 28,1994, documenting its staff review of the Mississippi final 10 CFR Part 20 1; equivalent rule, is enclosed for your information and use (Enclosure 1). The second part of {

the review was conducted by NRC staff and consisted of a review of the differences and @

inconsistencies identified by ORNL for compatibility and adequacy significance.

The NRC review focused on those provisions of the Mississippi rule that are required for .

compatibility or for health and safety under the new adequacy and compatibility policy ~

statement approved by the Commission by Staff Requirements Memorandum dated

June 30,1997 (Enclosure 2 describes the new compatibility categories). General Comments The Mississippi (MS) regulations closely follow the Draft Suggested State Regulations (DSSR). As a result, the e are few difference between the MS regulations and the DSSR.

There are five provisions that are f1OT compatible with Part 20 (1,2,3,5,6). These are the same ones that were found to be non compatible in the .

DSSR.

There are two provisions that contain important typographical errors (4,7).

The ORNL analysis Major Point 2 (p. 2) states that MS excludes registrants, registrations and registered material from the requirements of the'-

regulations although they are covered by the DSSR. and some provision of the MS State Board of Health Environmental Regulations Section D.

including the scope (801.D.2).A. However, in MS, registrants refer to persons using radiation machines, like X-ray equipment, so that the systematic deletion of the term in MS regulations is correct, although optional in the DSSR.

Specific Comments

1. 801.D.201 Occupational Doce Limits for Adults (Division 1. Designation A)

The MS regulations and DSSR add the words, " determined as follows," to "The assigned deep dose... highest exposure." This is not compatible -

because it provides a different meaning. Also, see ORNL Comment, p.10. The Final SSR language deletes the wording, " determined as follows" and is compatible.

2. 801.D.202 Requirements for summation of cxtemal and intemal doses (Division 1, Designation A)

Both the MS regulations and the DSSR uses Hw rather than H 1, This is an important term, and therefore is not compatible. The error was corrected in 1994 and the FSSR is now compatible. Also, see ORNL Comment, p.10.

3. 801.D.802 Control of material not in storage (Division 2 Designation D).

Both the MS regulations and the DSSR add "or in a patient" after "...not in storage." This is not compatible. The phrase was removed from the FSSR "d is now compatible. Also, see ORNL Comment, p.13.

Rule Review: [ Agreement State ] Part 20 equivalent compatibility requirements The MS regulations use the citation "172.436.440" instead of "172.436-440" in the DSSR and 10 CFR Part 20. Although compatible, this important typographical error should be corrected. Also, see ORNL Comment 2, p.' 15.

5. 801.D.205 Determination of prior occupational dose (Division 1, Designation D)

The MS regulations and the DSSR do not contain language pertaining to partition doses. The MS regulation states," Licenses are not required to reevaluate the separate external dose equivalents orintakes.. " This language is not compatible with 10 CFR Part 20. The FSSR, consistent with 10 CFR, gives compatible language: " Licensees or registrants are not required to partition historical dose between extemal dose equivalent (s) and internal committed doses equivalent (s)." Also, see ORNL Comment, p.19.

6. Part 801, Appendix B (Division 1. Designation A) ,

The MS regulations and the DSSR do not contain the statement: "The class (D, W, or Y) given in the column headed " Class" applies only to l the inhalation ALis and DACs given in Table 1 Column 2 and 3." The omission of this sentence makes the provision not compatible. The FSSR contains the indicated statement and is compatible. Also, the MS regulaton and DSSR omit the unit "ml" from the CFR volume, "2.4 x 10' ml." This important unit should be included.

7. 801.A.2 Definition " Curie" (No Division, No Designation)

The MS regulation uses a non-standard symbol for the micro prefix which should be denoted by "u" and not by "u." Also, see ORNL Comment 12, p. 26. Although not a compatibility issue, this error should be corrected.
