In accordance with 10 CFR 50.4(b)(1), enclosed is a Oyster Creek license amendment request and technical specification change request (TSCR) No. 253. The purpose of this license amendment and TSCR is to 1) reflect in the Oyster Creek License the registered trade name of "OPU Energy" under which the owner of Oyster Creek now does business and,2) reflect a change of the legal name of the operator of Oyster Creek from GPU Nuclear Corporation to GPU Nuclear, Inc. in addition, two minor editorial corrections are included.

Using the standards in 10 CFR 50.92, OPU Nuclear, Inc. has concluded that these proposed changes do not constitute a significant hazards consideration, as described in the enclosed analysis performed in accordance with 10 CFR 50,91(a)(1). Also enclosed is a Certificate of Service for this request, certifying service to the chief executives of the township and county in which the facilities are located, as well as the designated official of the state of New Jersey, Bureau of Nuclear Engineering.

l. LICENSE AMENDMENT AND TECIINICAL SPECIFICATION CilANGE REOUEST

,- , (TSCR) NO. 253 GPU Nuclear, Inc. requests that the following changes be made to the existing Oyster Creek License and Technical Specifications (TS):

A. License replacement pages: 1,2, and 3 B. Technical Specifications replacement pages: 61,6 3,6 5,6 7, and 6 20 C. New Technical Specification page 6 21

11. REASON FOR CilANGF; The purpose of the license amendment is to reflect the use of the trade name GPU Energy registered by Jersey Central Power and Light Company, the Metropolitan Edison Company, and Pennsylvania Electric Company Jersey Central Power and Light is the owner of Oyster Creek. The license amendment and TSCR also reflect the change in the legal name of the operator of Oyster Creek from GPU Nuclear Corporation to GPU Nuclear, Inc. On pages 6.1 and 6.7, a minor correction to a position title have been made.

The name changes have been made in accordance with a series of name changes implemented by GPU, Inc.' to improve customer, employee and business recognition for the GPU family of companies it is important to note that the owner of Oyster Creek, Jersey Central Power and Light, will continue to exist and maintain its legal name. Owner related correspondence submitted to the NRC on the docket will reference both the Owner's legal names and the common trade name GPU Energy is not a separate entity; it is the registered common trade name that is being used to reflect the unity of focus and purpose.

111. SAFETY EVALUATION JUSTIFYING CilANGE TO OYSTER CREEK LICENSE AND TECHNICAL SPECIFICATIONS The proposed changes to the license for Oyster Creek that reflect the trade name of the Owner and that reflect the change in the legal name of the operator, have no impact on the continued safe operation of the Oyster Creek Nu:: lear Power Station. The corporate existence of the owner and the operator of Oyster Creek continues uninterrupted, and all legal characteristics remain the same. The name changes do not alter the state of incorporation, registered agent, registered oflice, directors, officers, rights or liabilities of either the Owner or the operator of Oyster Creek. Similarly, the name changes do not alter the function of either the Owner or the operator of Oyster Creek nor in the way they

do business. The Owner's financial responsibility for Oyster Creek and the source of funds to support the facility remain the same. These name changes dn not impact the existing ownership of Oyster Creek and do not alter any of the existinglicensing conditions applicable to Oyster Creek. There is no change to OPU Nuclear, Inc.'s ability to comply with these licensing conditions or with any other obligation or responsibility under the license. Specifically, the Owner of Oyster Creek remains a regulated electric  ;

utility. The funds accrued by the Owner continue to be available to fulfill all obligations related to Oyster Creek as they were before the name changes.

There will be no impact on the safe operation of Oyster Creek as a result of the name change. Access to funds necessary to safely operate Oyster Creek to the end oflicense is unaffected. Access to decommissioning trust funds to casure that Oyster Creek can be decommissioned in accordance with NRC regulations remains as it was prior to the name changes.

IV. NO SIGNIFICANT llAZARDS CONSIDERATJON ANAIMSIS ,

GPU Nuclear, Inc. has detennined that the proposed Oyster Creek license amendment and technical specification change request involve no significant hazards consideration as defined in 10 CFR 50.92 because:

Operation of the facility in accordance with the proposed amendment would not involve a significant increase in the probability of occurrence or the consequences of an accident previously evaluated. The proposed amendment adds to the license and the technical specifications the trade name of the Owner of Oyster Creek. The change in the legal name of the operator of Oyster Creek is an administrative change made to reflect the name changes made throughout the GPU family of companies. The name change has no impact on plant design or operation.

Operation of the facility in accordance with the proposed amendment would not create the possibility of a new or different kind of accident from any accident previously evaluated because no new failure modes are created by the proposed changes. The use of a trade name for the Owner of Oyster Creek and the change in the legal name of the operator of Oyster Creek has no impact on plant design or operation. Thus, there is no creation of the possibility of a new or different kind of accident from those previously evaluated.

Operation of the facility in accordance with the proposed amendment will not involve a significant reduction in a margin of safety. The proposed amendment does not change any operating limits for reactor operation.

V. IMPLEMENTATION It is requested that the amendment authorizing this change become effective upon issuance.
