SUBJECT: NRC INSPECTION REPORT 50-482/98-04, NOTICE OF VIOLATION, AND

EXERCISE OF ENFORCEMENT DISCRETION i

Dear Mr. Maynard:

From January 25 through March 7,1998, a resident routine inspection was conducted at your

Wolf Creek Generating Station reactor facility. The enclosed report presents the scope and

results of that inspection.

Violation A is being cited because the operations department interpretation of Technical

Specification 3.1.3.5 failed to recognize that it applied during surveillance testing. Violation B is

being cited despite your staffs identification, because the corrective actions were not adequate

to have identified the additional example reported in your licensee event report supplement.

Violation C is being cited because weaknesses in the radiation protection program, coupled with

weaknesses in individual radiation worker performance, resulted in two examples of

noncompliance with radiation work permit requirements.

These violations are cited in the enclosed Notice of Violation (Notice) and the circumstances

surrounding the violations are described in detail in the enclosed report. Please note that you

are required to respond to this letter and should follow the instructions specified in the enclosed

Notice when preparing your response. The NRC will use your response, in part, to determine

whether further enforcement action is necessary to ensure compliance with regulatory

requirements. Because Violation B was reported in Licensee Event Reports 50-482/96-009-00

and -01 in sufficient detail to adequately describe the event and your corrective actions, and

these actions appear to be adequate, no response is required. 4

in addition, a violation of 10 CFR 50.71(e) was identified. This violation would be classified at

Ag,

Severity Level IV and normally would be cited because it was identified by the NRC. However,

after consultation with the NRC's Office of Enforcement, the NRC is exercising ,

discretion (EA 98-148) in accordance with Section Vll.B.3 of the Enforcement Policy and is not

taking formal enforcement action. Specifically, the NRC recognizes that you have underway a

comprehensive program to review and update the Updated Safety Analysis Report. This

program was described in Wolf Creek Nuclear Operating Corporation Letter ET 97-0010 dated

February 7,1997. It is the NRC's view, given the scope and schedule for completing this review,  ;

that this Updated Safety Analysis Report discrepancy likely would have been identified through

' the Updated Safety Analysis Report review program,

in accordance with 10 CFR 2.790 of the NRC's Rules of Practice," a copy of this letter, its
