AMENDMENT OF 10 CFR PART 9, SUBPART A. " FREEDOM OF INFORMATION ACT REGULATIONS" Attached for your signature is a memorandum that informs W Commission of the CIO's intent to publish the attached proposed rule.
The_ proposed rule amends 10 CFR Part 9, Subpart A, to implement recent amendments to the Freedom of Information Act (FOIA). The amendments to the F0IA are designed to bring the act into the information and electronic age by
' indicating that FOIA applies to records maintained in hard copy or electronic
. format. The amended act is known as the Electronic Freedom of Information Act Amendments of 1996 (EFOIA).
The proposed rule will implement statutory provisions of the EF01A that require certain categories of agency records be made publicly available electronically: will implement amendments that change the statutory time for res]onding to requests from the 10 working days formerly required to 20 worcing days: will establish procedures for collaborating with requesters to tailor requests in a way that will enable NRC to be more responsive to the requester: will amend NRC's F0IA regulations to comply with the requirements of the _new statute; and will make minor editorial and technical changes to make the regulation more accurate and readable.
Coordination: The Office of the General Counsel, the Chief Financial Officer, the Executive Director for Operations, and the Director. Office of Administration, have concurred in the proposed rule. The Office of the Inspector General has reviewed the proposed rule and has no objection to its contents.
